NumberMill's IR35 Protect Service

Background:

As we are all aware, there have been multiple legislative changes by HMRC to try to raise standards in the sector, and to ensure that more taxes are collected and to stamp out tax evasion.

Obviously, this has not worked exactly the way that they have wanted to as the vast technical nature of the legislative changes is extremely difficult to navigate, and consequently there have been even more aggressive tax schemes, which are heavily disguised, putting both contractors and the agencies at risk.

Also, a recent introduction guidance and draft legislation could also put agencies and in some cases, end hirers, at even further risk as this would place the onus and liability for lost taxes and NIC on to them.

How can NumberMill help?

In response to this, NumberMill have developed a service called “PROTECT” which will shield you as the agency, the contractor, and end hirers from this risk.

Additionally, with the introduction of the Criminal Finance Act in September 2017, end hirers and agencies have the responsibility to ensure compliance in the supply chain.

 PROTECT means that contractually, liability is removed and transferred to NumberMill.

With this, NumberMill become the HMRC recognised “Fee Payer” and will assume full responsibility for the payment of workers, correct deductions of taxes and RTI submissions.  

Where appropriate in depth IR35 status reviews are undertaken and evidenced for HMRC and this will allow gross payment to Ltd Company contractors. Failing this we can offer the contractor our compliant FCSA accredited umbrella employment service. 

 We base our services on technical understanding of the legislation, partnership with legal employment experts and by offering a wide range of compliant contractor-based services.

 NumberMill who are ACCA qualified, IR35 specialists and FCSA Accredited are so confident about their levels of compliance, are willing to absorb all this liability, PROTECTing the entire supply chain while focusing on maintaining margin, minimising cost in the contractor supply chain, maximising our client’s margin and providing an efficient happy service to contractors.

What can we do to help?

We have a number of services that we recommend;

 1) IR35 reviews

 2) Outsource payment of Ltd Co Contractors with or without fee payer protection as required

 3) Choose our FCSA accredited umbrella

 Our recommendation at this time of uncertainty, would be to start outsourcing the payments of your limited company contractors to us, which would in turn save back office costs and would include insurance.

 The price of this can be negotiated based on volume. 

If you operate in the Public Sector we can also consider the “Fee Payer” service. In the private sector currently fee payer isn’t required, but the aim of this would be to get your business prepared for the up coming IR35 reforms come April 2020.  

 Contractors engaged via PROTECT are covered by NumberMill’s insurance as well (Public Liability, Employers Liability & Professional Indemnity and DNI if appropriate).

Once the reforms comes in to force in April 2020, we would then be able to change and offer our IR35 Protect with fee payer liability protection, this will allow a far easier transition.
