November's Tax Pro Tip: The Importance of Compliance

TAX PRO'S TIP: The Importance of Compliance

Today I would like to discuss the importance of compliance. If the IRS were to grant you an Installment agreement, or an offer in compromise, you agree to stay in full compliance with all paying and filing requirements. What this means is that you will file all returns that you are required to file and make all payments as required by law. This includes Federal Tax Deposits, Estimated Payments, and proper withholding from your paycheck.?

Often, I speak with taxpayers that want to start paying off their oldest tax years first and not wonder what the correct thing to do is. I always tell taxpayers (even while working at the IRS) that?they should pay the current year's and the following year's taxes, and then we can devise a plan to work on the back taxes.?

The reason for this is twofold:

  1. You want to prove that you can stay in compliance and work with the IRS
  2. You can prevent major IRS penalties by paying the current year's tax.?

If you enter into an installment agreement with the IRS and forget to file or owe for another year, you will have defaulted on that agreement.

In the case of an offer in compromise, you promise?to stay in full compliance for at least five years after?you satisfy the terms of the offer. The IRS has special units located in Brookhaven and Memphis that monitor accepted offers for payments and compliance for five years.?
