New ways of Negotiation

You need ideas and concepts of academics and trainers and as well as practical on the job kind of training/ negotiation of actual cases to come up with pragmatic , existential and balanced wholistic negotiating competency .

Some paradigm shifts must take place. This is fast changing times. Lawyers and corporate counsel or in-house counsel can diversify from purely legal mattters to deliver a wider value as negotiators. From fire-fighting to fire-prevention , from managing to leading; from win-lose scenario to mutual interests gain ; from not accepting litgation as usual to value-creative processes to secure outcome within and beyond the courts.

Many disputes or conflicts are acknowledge and identify up-stream with a healthy perspective that early diagnosis of good health or bad health means treatment and therapy can heal and cure them early. Managing the dispute before it escalates to a serious dimension of cancerous proportion that invasive surgery is necessary .

In-House Counsel or corporate counsel and even lawyers should be in a position to practice from old paradigm of positional bargainers ( of wants and demands) to the new paradigm of inquiring into the needs and interests during negotiation. The gladiator approach should be avoided.

New ways of negotiating are the trend , they are pragmatic, fast , value-creative and sustainable. The downside to litigation is expensive costs, bitter relationship, no finality, wastage of time , and no value created.

CEOs , In-House Counsel/ corporate counsel are increasingly expected to be creative in their strategies in managing risks and reducing cost in securing effective outcome. Therefore to be pro-business and to help business of companies all CEOs, Corporate Counsel should become good general counsel , empower to lead, innovate, inspire and increase their value. Cross-cultural competency of cross cultural framework is import.

Prepare better, and faster and the preparer is at the centre of negotiations. The business industry needs Negotiators who have the hard, soft and value-creative skills to improve the effectiveness of negotiation . Companies that understand and realise this need , do best to look and employ effective Negotiators to assist and help them to improve the quality and effectiveness of negotiated outcomes.
