New Update from OpenAI

In this morning's live video, OpenAI announced and discussed several key updates and product announcements that are set to shape the future of AI technology. We took a moment to review, so you don't have to, the top new product announcements and the major legal considerations that business owners should be aware of. And yes, we used AI (the "genius" level setting of You.com ) to help us review this 26 minute long video in about 45 seconds.

Key Product Announcements

1. Introduction

OpenAI emphasized the importance of making their product broadly available, reducing friction for users, and announced the release of the desktop version of ChatGPT.

2. Launch of GPT-4o

The major announcement is the launch of GPT-4o, a new model that brings GPT-4 intelligence to everyone, including free users. The company plans to demonstrate the capabilities of this new model through live demos in the coming weeks.

3. ChatGPT Improvements

ChatGPT is now available without the sign-up flow, and the user interface has been refreshed. The goal is to make the experience of interaction more natural and easy, allowing users to focus on the collaboration with ChatGPT.

4. GPT-4o Capabilities

GPT-4o provides GPT-4 intelligence but is much faster and improves on its capabilities across text, vision, and audio. It reasons across voice, text, and vision, and its efficiency allows the company to bring GPT-4o intelligence to free users. Need an answer to an audio query? It’s got you covered in 232 milliseconds flat, averaging around 320. That’s practically real-time conversation.

5. GPT-4o in the API

GPT-4o is not only available in ChatGPT but is also being brought to the API. This allows developers to start building with GPT-4o and deploy AI applications at scale. GPT-4o is faster, 50% cheaper, and has five times higher rate limits compared to GPT-4 Turbo.

Now, the lawyer inside of me would like to highlight the following legal considerations business owners should pay attention to when leveraging this new update:

1. GPT-4o Launch: Data Privacy and Intellectual Property Rights

Just because something is easier and faster to use, it's important to remember and consider consider data privacy laws such as the General Data Protection Regulation (GDPR) in the EU or the California Consumer Privacy Act (CCPA) in the US. These laws mandate businesses to safeguard user data and provide transparency about how this data is utilized. Regarding intellectual property rights, the AI may generate content that could potentially infringe on existing copyrights. Here's a good overview of US privacy laws.

2. ChatGPT Improvements: Data Protection and Misuse

With the removal of the sign-up flow for ChatGPT, businesses need to ensure they are still compliant with data protection laws. When it comes to your team or employees, don't leave anything for granted. Make sure everyone knows what they're agreeing to when signing up and using. Also, in terms of misuse, there is a risk that users could use the platform to disseminate misinformation or harmful content.

3. GPT-4o Capabilities: Privacy and Copyright Issues

As GPT-4o reasons across voice, text, and vision, businesses must be aware of potential privacy issues. When recording voice, understand and respect state privacy recording laws (different consent requirements). In terms of copyright and as always, the AI's outputs must not infringe on any copyrights or trademarks.

4. GPT-4o in the API: Compliance and Liability

When using the API, businesses must ensure they are compliant with the terms of service. In terms of liability, businesses should be aware of potential legal issues related to the use of AI, such as liability for decisions made by the AI or potential bias in the AI's outputs.

While OpenAi's new product updates and announcements bring exciting advancements in AI technology, it's essential for businesses to navigate the legal landscape carefully to ensure compliance and ethical use of these powerful tools.
