New Measures to Tackle Fake Employment Practices

The Ministry of Human Resources and Emiratization has issued Resolution No. 318 of 2024, targeting companies with no genuine employment relationships and those not practicing their licensed activities.

Inspection and Enforcement

To enforce this resolution, the Ministry will use its inspection system and impose administrative measures on violators. This includes:

  • Freezing work permits.
  • Imposing fines as per Cabinet Resolution No. 21 of 2020.
  • Reclassifying the facility as a third-category company.

Service Suspension

The Ministry will halt its services to these companies, except for work permit cancellations or registering absconding reports. Additionally, new facility registrations will be suspended for owners of these violating companies, and services to sole establishments owned by these individuals will also be stopped.

Penalties for Fake Emiratization

Companies with UAE citizens registered for fake Emiratization processes will face administrative and penal actions under Federal Decree Law No. 33 of 2021 and its regulations.

Decision Authority

The Undersecretary for Human Resources Affairs will make administrative decisions against violators.

Collaboration with Authorities

The Ministry will report these companies and their owners to relevant authorities, including the Ministry of Economy, Federal Authority for Identity and Citizenship, Customs and Ports Security, Departments of Economic Development, Municipalities, and Chambers of Commerce and Industry. These authorities will then implement legal procedures and restrictions on the violators.

Effective Date

This resolution is effective immediately from its issuance date.
