New Mandatory Rest Day in Mexico

To Our Clients and Friends:

Please be advised that on September 18th, 2024, the Mexican Senate approved a reform to the Mexican Federal Labor Law (MFLL), changing the official holiday previously observed on December 1st to October 1st, in alignment with the transfer of the Federal Executive Power.

This reform amends section VII of article 74 of the Mexican Federal Labor Law, establishing that October 1st, every six years, will now be a mandatory rest day to mark the transfer of the Mexican Presential/Federal Executive Power.

The proposed bill was sent to the Mexican House of Representatives for its review, ruling and eventual approval; thereafter, the Bill must be published to be enacted in order for the new official rest day be applicable to all workers.

If October 1st becomes the designated holiday and a worker is required to work on that day, they will be entitled to their regular daily wage plus an additional double payment. In practical terms, this translates into triple payment for the day.

Please keep in mind that workers are not obligated to provide services on designated rest days.
