New Family Justice Court Rules

What you should know about the new rules [in brief] to be implemented on a date to be announced.

  1. It will simplify the process.
  2. There's a single mode for commencing divorce/judicial separation.
  3. Plaintiff is now an Applicant whilst the Defendant is a Respondent.
  4. Time period no longer exclude non-working days.
  5. Parties have a duty to consider AMICABLE Settlement.
  6. MOA will now be called Notice to Contest, and filed in 14d instead of 8d.
  7. Reply and Cross-Application within 28d instead of 22d.
  8. Once a date for Interim Judgment is given, you need to file your AOM within 4 wks.
  9. When you file a summons application with a supporting affidavit, you only have ONE CHANCE to file that affidavit.
  10. When it comes to assets - there will be MANDATORY disclosure.
