New Criminal Laws July 1st 2024
Changes in Criminal laws from July 1, 2024
Previously the criminal laws followed in our country were Indian Penal Code 1860 (IPC), Criminal Procedure Code 1898 (Cr. PC), and Indian Evidence Act 1872 (IEA).
Now the new acts are following:
1 Bhartiya Nyaya Sanhita (BNS)
2 Bhartiya Sakshya Act (BS)
3 Bhartiya Nagrik Suraksha Sanhita (BNSS)
These bills got president assent on 25th Dec, 2023 and date of enforcement from 1st July, 2024.
Areas where these legislations will bring in changes are sedition/treason, terrorists and terrorism, trial in absence of accused, death penalty for rapes and sexual assault, higher punishment for hit and run crime.
BNS – 358 Sections/ IPC- 511 Sections
BNSS- 531 Sections/ CrPC- 484 Sections
BS-170 Sections/ Evidence- 167 Sections
Changes in BNS (358 Sections)- 22 sections repealed, 8 new sections added, and changes in 175 Sections. ?Earlier used to be IPC.
Section 69-Sexual intercourse through deceptive means
Section 109-Organized Crime and Penalty
Section 111- Penalizes Terrorism
Section 150- New form of Sedition
Section 195-Penalty for spreading false info
Section 226-Penalty for attempt to commit suicide
Section 101-Expands Murder Grounds
Section 304- Snatching as an offence
Death Penalty-For crime Against girls below 18 yrs of age
Section 377 of IPC not covered in BNS and can be an area of concern.
Changes in BSA (170 Sections)- 5 sections removed, 1 new sections added, and changes in 23 Sections.? Earlier used to be Indian Evidence Act.
Section 57-Electronic Record as Primary Evidence
Section 24-Joint trial for multiple people
Section 58-Expands list of secondary evidence

Changes in BNSS (531 Sections)- 9 sections repealed, 9 new sections added, and changes in 160 Sections.? Earlier used to be Criminal Procedure Code.
Section 176-Forensic investigation for crimes with 7 years or more.
Section 173-Electronic Mode
Section 356-Judgment in absence of proclaimed offender
Section 173(1)-Zero FIR
Section 195-Penalty for spreading false info
Section 349-Finger impressions and voice samples by Magistrates

The above sections of IPC for BNS will be applicable from 01.07.2024
Highlights of the new criminal bills:
BNS
1 Whether to Prosecute Terrorism under UAPA or Section 113 of the BNSS?
2 Cruelty against woman now covered under Section 86 of the Bill
3 Section 73 punishes unauthorised publication of court proceedings.
4 Section 367 added to include unsoundness of mind along with intellectual disability.
5 Mob lynching is now treated at par with murder
BNSS
1 Section 23 defines now community service.
2 Section 251,262,266, 308 etc. to have proceedings vide audio-video method.
3 Police custody beyond 15 days is still a matter of concern as Section 187(3) is unclear.
BSA
1 Electronic evidence fully acceptable under section 61 subject to Section 63.
Concern – Police custody beyond 15 days till 60/90 days will attract more misuse of power and forceful commission by accused. This needs to be checked and tested.
