The new casual employment information statement

On 26 August 2024 the laws of casual employment under the Fair Work Act 2009 are changing. ?Our first bulletin was about the new definition of casual employment. Our second bulletin was about the new requirements about casual conversion to permanent employment.

This bulletin explains the new requirements for issuing the casual employment information statement.

The statement

Most employers will be aware that a casual employee should be given before commencing, or as soon as possible after they start, both the Fair Work Information Statement and the Casual Employment Information Statement.

Updating the statement

The Casual Employment Information Statement will be updated. ?When it is available, the new version should be used from 26th August 2024. ?Until then the current version should still be used.

Issuing the statement

Until now the statement only has to be given once – before the casual starts, or as soon as practicable after. ?That is changing from 26th August 2024.

Small business employers will be required to give the statement:

  • Before the casual starts, or as soon as practicable after.
  • 12 months after starting.

Employers (not small businesses) will be required to give the statement:

  • Before the casual starts, or as soon as practicable after.
  • 6 months after starting.
  • 12 months after starting.
  • Each 12 months thereafter.

What Should Employers Do?

Employers should:

  • Consider how to adjust their processes to the changing requirements for issuing the Casual Employment Information Statement.
  • Use the updated Casual Employment Information Statement from 26th August 2024.
