New ADA Title II Digital Accessibility Requirements

The Americans with Disabilities Act (ADA) Title II now mandates that all state and local governments, along with their third-party contractors and software vendors, must comply with WCAG 2.1 A/AA standards. This rule, published by the US Department of Justice on April 24, 2024, requires accessible digital services within two to three years depending on the population size served. This new requirement underscores the urgency for immediate action, particularly given the often underfunded nature of public services.

Key Points:

  • Who Must Comply: All state and local governments across the U.S., including a wide range of public bodies such as municipal offices, public schools, and libraries, as well as their third-party contractors and software vendors.
  • Requirements: Websites, mobile applications, and digital services must meet WCAG 2.1 A/AA standards to be accessible to individuals with disabilities.
  • Specific Implications: This includes services like parking payment apps, website template providers, payment processors, educational technology platforms, and more.
  • Urgency: Third-party vendors must begin compliance efforts immediately to meet the tight deadlines and avoid potential legal repercussions.

Why This Matters: Ensuring digital accessibility is not just about legal compliance but also about providing equitable access to essential public services for all individuals, including those with disabilities. This regulation emphasizes the importance of inclusivity in digital design and development.
