“Parole in Place”
On June 18, 2024, the Department of Homeland Security (DHS) unveiled a significant initiative aimed at enhancing family unity within the immigration system, fulfilling President Biden’s pledge. Effective August 19, 2024, DHS launched Keeping Families Together, a program enabling certain noncitizen spouses and stepchildren of U.S. citizens to request parole in place. This process leverages existing statutory authority under section 212(d)(5)(A) of the Immigration and Nationality Act (INA), allowing noncitizens present in the U.S. without formal admission or parole to be temporarily present for humanitarian or public benefit reasons.
Parole in place under this initiative allows eligible noncitizens to apply for adjustment of status to lawful permanent resident without needing to leave the U.S. and go through consular processing. DHS estimates that around 500,000 noncitizen spouses and 50,000 stepchildren of U.S. citizens could qualify for this program. The process aims to address the needs of noncitizens who are already present in the country and wish to stay with their U.S. citizen family members.
To qualify for Keeping Families Together, noncitizen spouses must be in the U.S. without admission or parole, have been physically present since at least June 17, 2014, and have a legally valid marriage to a U.S. citizen. Similarly, noncitizen stepchildren must be under 21, unmarried, and have been present in the U.S. since June 17, 2024. Both groups must have no disqualifying criminal history and must pass background checks and security vetting. USCIS will rigorously review applications to prevent fraud and ensure the validity of marriages and other claims.

Green Card Approval Secured Without Interview
