The rapid evolution of Artificial Intelligence (AI) is transforming industries across the board, and the Property and Casualty (P&C) insurance sector is no exception. From underwriting and claims processing to fraud detection and customer engagement, AI promises to revolutionize how insurers operate. However, with great power comes great responsibility. As P&C insurers embrace AI, they must navigate a complex landscape of new risks, regulatory requirements, and ethical considerations—all while ensuring responsible AI use.

Here’s a closer look at the challenges and opportunities AI brings to the P&C insurance business, along with a roadmap for compliance in the US market.

The New Risks of AI in P&C Insurance

1. Technological Risks: The Double-Edged Sword of Innovation

AI’s reliance on vast amounts of data introduces significant risks, particularly around data privacy and security. Insurers handle sensitive customer information, from property details to claims history, making them prime targets for cyberattacks. Adversarial attacks, where malicious actors manipulate AI systems, further compound these risks.

Another critical concern is model bias and fairness. AI systems trained on biased or incomplete data can perpetuate discrimination, leading to unfair pricing or claims decisions. For example, an AI model might inadvertently charge higher premiums for certain demographics, violating anti-discrimination laws.

Finally, system reliability remains a challenge. AI models can produce inaccurate predictions due to poor-quality data or unforeseen edge cases. Over-reliance on AI without human oversight can result in costly errors, from mispriced policies to incorrect claim denials.

While model risk is not an new element and used to exist from the age of statistical development, the change is how a simple deviation gets the boost of self correction and in turn completely work negatively to the original objectives. Key elements of model risk include:

  • Conceptual Soundness: Models may be based on flawed assumptions or methodologies, leading to inaccurate outputs.
  • Data Dependency: AI models are only as good as the data they’re trained on. Poor-quality or outdated data can lead to unreliable predictions.
  • Overfitting: Models that perform well on training data but fail to generalize to real-world scenarios can result in poor decision-making.
  • Model Drift: Over time, AI models may become less accurate as the underlying data distribution changes (e.g., due to shifts in customer behavior or climate patterns).
  • Lack of Explainability: Complex AI models, such as deep learning algorithms, can be difficult to interpret, making it challenging to identify and address errors.

5. Intellectual Property (IP) Risks: Protecting Innovation

As insurers develop or adopt AI solutions, they must navigate intellectual property (IP) risks. As the models mature using both in-house and general global knowledge, the threat of class action , rights conflict are looming definitely for the enterprise. Enterprise should have keep and eye on and figure out processes to navigate around some of the IP related risks including:

  • Ownership of AI Models: If third-party vendors or open-source tools are used to develop AI models, questions may arise about who owns the resulting intellectual property.
  • Patent Infringement: Insurers must ensure that their AI systems do not infringe on existing patents, particularly in areas like predictive analytics or claims automation.
  • Trade Secrets: Proprietary algorithms and datasets used in AI models must be safeguarded to prevent unauthorized use or disclosure.
  • Licensing Issues: Using third-party AI tools or datasets may require compliance with licensing agreements, which could limit how the technology is used or shared.
