Re GDPR: you say that “its implications for NY law firms stretch across the Atlantic, affecting any firm that may contact or engage with EU residents through email marketing”. That isn’t how the extraterritorial scope of GDPR works, for example a NY law firm contacting individuals within EU businesses would not necessarily be in scope. Different matter of offering their services to consumer here. Also, the rules on email marketing itself are not to be found in GDPR (local implementations of the ePrivacy Directive, eg PECR in the UK, are where you’ll find that and where it is mandated whether opt-in or indeed double opt-in are required or not).
