Navigating IP and AI: What Authors and Coaches Need to Know about the Pirates of Silicone Alley

After our last roundtable , I asked our group for suggestions on what the next roundtable should cover. It came down to two subjects. The first and what I always consider a given is marketing. Running a close second was what ramifications AI will have on copyright law and Intellectual Property rights.
As authors, coaches, and content creators, we are witnessing a significant transformation in our industry due to the increased use of AI.?
AI tools are now part of our daily lives, but no one seems to know exactly what happens when you use AI to create content and how that will affect your ability to protect your IP with copyright or, more importantly, if it's actually your IP to protect.
So, since marketing is in some ways subjective and should be individualized based on the nature of the product, and since AI has become ubiquitous, we thought we would gather some experts so they can share their knowledge.
But first, some basic background information
The AI Revolution in Content Creation
Artificial intelligence is reshaping the way we approach content creation. Tools like ChatGPT and other AI platforms can enhance our productivity and creativity. However, as we integrate AI into our work, it's crucial to understand the implications for IP and copyright laws.
Ownership of AI-Generated Content
A pressing issue is determining who owns the content generated by AI. If you use an AI tool to help write a blog post or develop materials for coaching sessions does the resulting content belong to you, the AI, or the company behind the software?
Currently, the legal landscape is still evolving. Copyright laws have traditionally focused on human creators. Since AI does not have any rights (currently), it cannot hold a copyright. Nevertheless, the degree of human involvement in creating the content can significantly affect ownership rights. If you direct the AI and make creative choices, you are more likely to be recognized as the author of the work. But even that's not a clear-cut distinction, as you will learn.
Integrating AI with Your Original Ideas
Many professionals are using AI as a collaborative tool—a means to amplify their ideas and bring them to life faster and more efficiently. Understanding how this collaboration affects your IP and ability to protect your rights is essential.
For now, consider the following steps to ensure you're on solid ground:
Maintain Control Over the Creative Process: The more input and direction you provide, the stronger your claim as the author.
Review Terms of Service: Always check the AI tool's terms and conditions. Some platforms may have clauses regarding ownership and usage rights.
Document Your Contributions: Keep records of your inputs and the steps taken during creation. This documentation can be invaluable if disputes arise.
Copyright Considerations
Using AI does not exempt you from adhering to copyright laws. If the AI-generated content inadvertently includes copyrighted material, you could be held responsible. For instance, if an AI tool generates text that closely resembles existing works, your work may be considered some form of plagiarism.

To minimize these risks, here are further steps to consider:
Use Reputable AI Platforms: Choose well-known tools with robust policies to avoid infringing content.
Thoroughly Review Outputs: Always examine the AI-generated content to ensure it's accurate and doesn't infringe on other people's work.
Ethical and Authentic Content Creation
Beyond legalities, ethical considerations play a significant role. Authenticity is a cornerstone of our profession. While AI can boost productivity, overreliance may take your creativity, unique voice, and expertise and create a bunch of noise that will never be read.
Balance Is Key: Use AI to enhance, not replace, your creativity.
Transparency: When appropriate, inform your audience about the role of AI in your creative process.
AI offers remarkable tools that can significantly enhance our creative efforts. However, it's imperative to navigate the IP landscape carefully to protect our work and maintain professional integrity.
