As part of ensuring privacy and confidentiality and limiting potential misuse, we should encourage collecting only data that are necessary for a specific AI application.
The Kenya Data Protection Act (DPA) and AI
Kenya’s Data Protection Act (DPA) 2019 provides a robust framework for handling personal data, including health data, which is categorized as sensitive personal data. Some key principles of the DPA are particularly relevant to AI in healthcare.
Data Minimization
The DPA mandates that organizations collect and process only the data necessary for the intended purpose. For example, an AI-powered hospital scheduling system should only collect data related to appointment times, patient names, and medical needs. Collecting unrelated data, such as patient ethnicity or non-relevant financial history, would violate this principle.
Consent
Informed consent is a process of communication between a patient and health care provider, which includes decision capacity and competency, documenting informed consent, and ethical disclosure. Patients have the right to be informed of their diagnoses, health status, treatment process, therapeutic success, test results, costs, health insurance share or other medical information, and any consent should be specific per purpose, be freely given, and unambiguous.

The DPA stipulates that data collected for a specific purpose cannot be repurposed without additional consent. For instance, If an AI model collects data for diabetes management, this data cannot later be used to train a separate AI for marketing health supplements without obtaining fresh consent from patients.

So, how do we ensure that sensitive health data is secure and we remain compliant even as we introduce new technologies?
Implement Security Management Systems
This involves creating policies, procedures, and guidelines for data protection, and training staff on how to handle sensitive information securely. A security management system is a set of policies, procedures, and guidelines that are put in place to ensure the confidentiality, integrity, and availability of patient data. It involves creating?retention policies?and procedures that outline how data should be handled, stored, and protected. These policies and procedures should be in compliance with legal and regulatory requirements.
Data Encryption
Data encryption converting data into a code so that it can only be read by authorized individuals. The first step includes identifying which data needs to be encrypted. Typically, this includes personal health information (PHI) and personal identifying information (PII). There are several encryption methods available, including symmetric encryption, asymmetric encryption, and hashing. Each method has its own set of strengths and weaknesses, and the most appropriate method will depend on the specific needs of the organization. It's important to note that encryption should be part of a comprehensive security strategy. This strategy should be combined with other security measures such as firewalls, intrusion detection systems, and access controls.
Regular Data Backups
Ensure that sensitive information is not lost in the event of a data breach, system failure, or other disaster. Generally, encrypted data, such as PHI and PII, must be backed up. It’s wise to set up a backup schedule to ensure that data is backed up frequently and at appropriate intervals. You can use full backups, incremental backups, and differential backups depending on your?health records?needs.

This step is aimed at limiting who can access patient data and what they can do with it. Various authentication methods can be implemented, which include IDs, passwords or biometrics. For us to ensure ethical and responsible AI adoption in the Kenyan healthcare landscape, we should look to invest in training and capacity building to understand AI’s implications and opportunities, update existing regulations to address the unique challenges posed by AI, including provisions for AI-specific risks and prioritize user-centric design and ensure that AI systems are transparent, fair, and secure.
