National Innovation Visa Priorities - Priority 2

For global entrepreneurs, researchers, and creatives, this is an incredible opportunity to align your expertise with Australia’s growing innovation ecosystem. Whether your strengths lie in pioneering technology, revolutionary research, or groundbreaking business models, there’s a place for you here in Australia.

Australia's National Innovation Visa (NIV, subclass 858) is more than just a visa—it’s a pathway for global visionaries to bring their exceptional talents to one of the most innovative, forward-thinking nations in the world.

While Priority 1 focuses on global experts and award winners, Priority 2 offers an incredible opportunity for candidates nominated by Australian Commonwealth, State, or Territory Government agencies.

This priority is unique because it actively leverages local government support to identify and invite exceptional individuals across any sector who demonstrate outstanding achievements.

So, how will Priority 2 work? My predictions are:

1?? State or Territory Nomination

You will need to be nominated for this visa by an Australian state or territory government agency.

Every state and territory will have its own nomination criteria.

Usually, you would submit a completed Expression of Interest (EOI) through the state or territory government you intend to migrate to.

The state and territory government agencies can view your completed EOI and might nominate you for the visa.

If you are nominated, they would invite you to apply, and that would be your opportunity to proceed with your National Innovation Visa (NIV) Subclass 858 Expression of Interest (EOI) and be classified under Priority Level 2 when submitting your National Innovation Visa (NIV) Subclass 858 application with the Department of Home Affairs.

Before starting your journey, it’s important to contact the state or territory agency directly to learn more about their nomination process and requirements.

A friendly reminder: All state and territory government agencies have their own criteria for deciding who they will nominate. As of today’s date (of this article), Australia’s state and territory governments are in the process of developing the framework for State/Territory nomination under this program. The nomination process is not yet open, and the official timeframe is unavailable. Some are aiming for early this year—so watch this space!

Also, if the state or territory agency that nominates you withdraws your nomination after you have applied, your application usually becomes invalid.

2?? Exceptional Achievements Matter

Nominations are strengthened when you can demonstrate your achievements, this may include, but are not limited to, the following:

  • Recipients of internationally prestigious awards, such as Nobel Prize laureates, Fields Medal recipients, Booker Prize winners, or Olympic gold medallists.
  • Exceptionally talented individuals in their field who are endorsed by a relevant Australian state, territory, or federal government agency.
  • People with exceptional skills in critical technologies, renewables and low-emission technologies, and health industries.
  • Exceptionally talented professionals in agri-food and ag-tech, resources, defence capabilities and space, education, financial services and fintech, and infrastructure and transport.
  • Recognised intellectual property, such as international patents.
  • Innovative investment activity with a proven track record.

Nominations may potentially require state/territory-specific achievements too, which may include but are not limited to:

  • Entrepreneurial ventures with the potential for commercialisation, particularly if linked to state or territory innovation hubs.
  • Living and working in the state or territory throughout your provisional visa (if applicable).
  • Conducting your entrepreneurial activities in the state or territory of your choice.
  • Establishing your business headquarters in the state or territory where you choose to live and work.
  • Having a registered ABN for your business linked to your state or territory.

Remember, these are predictions!

3?? The Role of Local Governments

State and territory governments will play a vital role in identifying and nominating talented individuals who align with their economic goals.

While specific details for the NIV are yet to be confirmed, we have seen other programs—both temporary and permanent—where they have nominated candidates, such as the subclass 491, 190, 188, and 888 visas.

Usually, these types of visas require applicants to demonstrate ongoing contributions to their state. Could the NIV nomination criteria mirror this? Time will tell.
