MY VIEWS ABOUT H-1B

H-1B must be kept for American Graduates only

I felt a deep frustration seeing Indians who got their H-1B visas directly from companies in India without going through the process of earning an American MS degree. They don’t experience the long wait and struggle for an H-1B visa. These individuals get their H-1B visas while still in India and then come to the U.S. to join their organizations. They receive an initial three-year H-1B visa and can extend it once.

There are two main groups among these Indians who come directly from India with H-1B visas. The numbers of people from other countries with H-1B visas are much smaller in comparison. India takes the largest share of H-1B visas. Some of these individuals stay in the U.S. for six years, earn and save a lot, and then return to India as wealthy individuals. They don’t have a genuine interest in the U.S.; they come just to benefit financially.

The second group has more ambition. They change jobs midway, join new companies, and persuade these companies to file for their green cards. I believe the U.S. should stop giving H-1B visas to individuals without a U.S. degree. Only those with at least a U.S. degree (BS, MS, or Ph.D.) should be eligible for H-1B visas. This would ensure that people who have invested in U.S. education have a fair chance and help retain more American-educated professionals.

Imagine someone who completed an MS from an American university, spent a significant amount of money, took out loans, and faced rigorous assignments, only to fail the H-1B lottery multiple times. Meanwhile, individuals from companies like TCS, Wipro, and Infosys in India receive H-1B visas without much struggle or stress. It seems unfair that these individuals can get H-1B visas by simply applying from India while those who have endured the U.S. education system face more obstacles.

The USCIS should implement a rule that requires at least one U.S. degree for H-1B eligibility. This would filter out substandard engineers and ensure that only those who have made a significant educational investment in the U.S. are granted H-1B visas. The U.S. population is around 330 million, and the immigrant population continues to grow each year. If this trend persists, the ratio of Americans to immigrants will shift significantly in the coming years.

To maintain the balance and preserve American culture and heritage, it would be prudent to limit H-1B visas to individuals with U.S. degrees. Without an American degree, individuals should only be allowed to stay in the U.S. on a tourist visa for a limited time. This would help preserve the diversity and heritage of the U.S. and ensure that those who benefit from the U.S. system have genuinely earned their place.
