Complaints presently filed against MVP Health Care, Medicaid Managed Care Plan (MMCP) who conducts business in New York State Christipher Del Vecchio President & CEO at MVP Health Care : MVP HEALTH PLAN HAS BEEN ACCUSED OF VIOLATING SERIOUS HEALTH CARE LAWS. ACCUSATIONS THAT MVP HEALTH PLAN HAS LIED TO AND DEFRAUDED THE GOVERNMENT BY SUBMITTING FALSE CLAIMS HAVE BEEN FILED IN THE SUPREME COURT OF NEW YORK. MVP IS PRESENTLY ATTEMPTING TO DEFEND THEMSELVES AGAINST CLAIMS RELATING TO ABUSE, WASTE AND DISREGARD FOR PRIVACY LAWS. THIS HEALTH PLAN CONDUCTS BUSISNESS IN NEW YORK STATE AND HAS BEEN GENEROUSLY PAID TO MANAGE THE CARE OF CLOSE TO A MILLION INDIVIDUALS. COMPLAINTS THAT MVP ROUTINLY ENGAGES IN BLOCKING AND SHARING MEDICAL INFORMATION, BEHAVIOR THAT ENDANGERS THE HEALTH OF THEIR MEMBERS HAVE BEEN FILED WITH THE SPREME COURT, STATE OF NEW YORK. MVP HEALTH PLAN (MMCP), "NOT-FOR- PROFIT" IS GENEROUSLY PAID PUBLIC FUNDS TO USE TO USE METHODS TO INCREASE THE QUALITY OF CARE DELIVERED TO THEIR MEMBERS. THIS HEALTH PLAN AND THEIR ADMINISTRATORS HAVE BEEN ACCUSED OF FAILING TO USE FUNDS AS PROMISED. CLAIMS FILED IN COURT FURTHER ALLEGE THAT MVP ENGAGED IN ACTIVIIES "INTENDED" TO DECRESE DELIVERY OF MEDICAL SERVICES TO THEIR NEARLY ONE MILLION MEMBERS AND FAILED TO USE METHODS AS PROMISED TO INCREASE DELIVERY OF SERVICES TO THEIR MEMBERS. CLAIMS HAVE BEEN FILED THAT INTEND TO PROVE THAT MVP CONCENTRATED ON PESONAL FINANCIAL GAIN AND ACTIVITIES THAT CONTRIBUTED TO A DECREASE IN THE QUALITY OF CARE GIVEN TO THEIR MEMBERS. MVP HEALTH CARE AND IT'S LEADERSIPWHO ARE OR HAVE BEEN REPORTEDLY WELL CONNECTED IN ALBANY, NEW YORK STATE'S CAPITOL CLOSE TO WHERE MVP's HEADQUARTERS ARE LOCATED. CLAIMS FILED INCLUDE ALLEGATIONS THAT MVP ENGAGES IN RETALIATE AGAINST ONE VOICING COMPAINTS TO MVP ABOUT THE WAY MVP CONDUCTS BUSISNESS AND PRESUMEABLY HAVE HAD AN UMBRELLA OF PROTECTION UNDER ALBANY'S ADMINISTRATION IN PAST YEARS.

ACCORDING TO AN INVESTIGATION OF MVP BY THE ATTORNEY GENERAL’S OFFICE MVP Health Care, Inc., a not-for-profit corporation, has three subsidiaries that offer health plans to New York consumers: (i) MVP Health Plan, Inc. a not-for-profit health maintenance organization licensed pursuant to the provisions of Article 44 of the New York Public Health Law; (ii) MVP Health Insurance Company, a for-profit accident and health stock company licensed pursuant to the provisions of Article 42 of the New York Insurance Law; and (iii) MVP Health Services Corp., a not-for-profit health service 2 of 33 corporation licensed pursuant to Article 43 of the New York Insurance Law. In this Assurance, “MVP” will refer to the aforementioned entities. 2. MVP’s principal offices are located at 625 State Street, Schenectady, New York 12305. 3. In the regular course of business, MVP enrolls consumers in health plans and contracts with health care providers for the delivery of health care services to those consumers. Offering about 300 different health plans in New York State, MVP provides health care coverage for approximately 500,000 New York consumers. In 2012, MVP had revenues of $2.7 billion.

THERE EXISTS NO EXCEPTION TO BLOCKING THE SHARING OF INFORMATION AS TO COMPLINTS ENTERED AGAINST MVP HEALTH PLAN THAT THEY ARE GUILTY OF BLOCKING. MVP IGNORES RULES STATED IN THE PRIVACY ACT AND BELIEVES THAT NEW RULES WRITTEN FOR ARTIFICIAL INTELLIGENCE (SOFTWARE & EMR SYSTEMS) ARE TO BE INTERPRETED AS BEING APPLICABLE TO HUMAN INTERACTIONS RELATING TO REQUESTS FOR AND THE SHARING OF INFORMATION. RULES REGARDIG THE SHARING OF INFORMATION BETWEEN HUMANS, UNLIKE THOSE WRITTEN FOR COMPUTERS ARE ALSO GOVERNED BY LAWS OF COMMON SENSE,

MVP HEALTH PLAN ALSO GUILTY OF BULLING A PARTICIPATING PROVIDERS FOR VOICING COMPLAINTS: If you're a doctor participating with this plan and feel that you are being treated unfairly or notice that the plan is not complying with regulations which state how they are required to?conduct business, feel free to contact me. f you complain to them first, they'll bombard you with insignificant litigation in terms of accusing you of anything. Here's an example of what they did to me after my staff after we voiced complaints to this Company. I spoke with someone at MVP who had been given orders not to speak with me. But, he agreed to ignore the order and he agreed to speak with me. We mutually agreed to speak about issues relating to follow-up care on patients. Two months later, even though they have an in-house team of lawyers, they hired an outside law firm who bombarded me with paperwork that I had to answer,?requesting that the Supreme Court issue an order to me that I can't speak to anyone at MVP, lying to the Court that I spoke with MVP when I was "told" not to. They lied to the Court, leaving out the fact that MVP and I agreed to talk. Much ado about NOTHING. Hard to believe but true. MVP filed a lawsuit against me stating that a "letter"?was sent to me saying that I couldn't speak to anyone at MVP, informing the court that I "violated" a "demand" (a simple letter sent to me not to speak to anyone). They filed this lawsuit against me AFTER MVP and I agreed to talk. It was MVP, even, who called me first. When I say bombard, I mean bombard you with litigation if you dare complain about anything if you have a working relationship with this company, MP Heath Plan. By now, they could have spent over a hundred thousand dollars, hiring not just one large law firm but 2 large law firms, to protect themselves against complaints I made; complaints that they were not sharing information with me. ALL TRUE!! They have?filed papers in Court that I've had to respond to, asking that a Supreme Court Judge rule that they've done nothing wrong on "numerous things" as if 've filed a lawsuit against them. I initiated no litigation against them. They have spent over TWO YEARS, throughout the entire Pandemic, paying two large Law Firms to defend themselves against what I thought was just a minor complaint I just "voiced" (l had no idea that my complaint would warrant such an overwhelming response). Someone has to speak up and prevent these companies from thinking they are above the law. I guess they thought they'd wear me out as, presumably, they might have done this to others who dared voice complaints to them. But with me, MVP had no idea that?I would not back down to them, motivated by the fact that three of my five sons are doctors (a fourth a Dentist) for whom my wife and I will fight for with hopes of preventing these corporations from exerting such control over our healthcare system in such a way that Doctors are threatened if they dare speak up, as we've recently seen Doctors being threated who voiced their "opinions" or complaints about the Covid 19 Vaccines. Doctors were threatened that their licenses would be taken away from them if they spread misinformation about vaccines while two major new stations and members of two Political Parties continue to express their opinions in any way they want about the Covid 19 vaccines without any warnings being issued to them.???????????????????????????????????????????????????????????????????????????We all, ALL AMERICANS HAVE HAD ENOUGH AND CAN'T STAND THIS ANYMORE. (SO MUCH CONTRADICTORY INFORMATION FROM SO MANY SOURCES THAT WE DON'T KNOW WHAT TO BELIEVE ANYMORE)???????????????????????????????????????????????????????????Many of us have begun to speak up against the Corporate control that has taken over and weakened America's Health Care System.?????So, I'm not backing down to this company. Luckily my wife is an attorney and although off record, she has been my private counsel in every aspect of how I've responded to MVP's relentless attempts to shut me up.??????????????????????????????????????????????????I I say, luckily my wife is an Attorney because everyone should know and be prepared and know that you will receive no help from anybody as you defend yourself against any retaliation you might experience?from a large Medicaid Managed Care Plan such as MVP.. You're on your own, even though a company, like MVP, operates !00% using Public Funds. You can report this everywhere ( state oversight agencies, the AG Office, etc.) who will take your report, but will put their investigation on hold and not conduct a thorough investigation of your complaints, will not ask you for any documentation to support any complaint you enter, because laws are in place,?stating that you can not sue a company on behalf of the Government, the Gov't as well, if collateral litigation is taking place which I'm sure MVP has more awareness of than me, so I'm prepared to do whatever it takes to end this case, put an end to a process that MVP wants to keep going for years and I will keep those of you who have followed me with interest on this subject informed(other advocates for changing and improving our healthcare system).???

So know that if a company prevents you from initiating any kind of lawsuit on behalf of the state with regards to any funds they've been given by the state, until all collateral litigation is resolved, as the litigation MVP has imposed on me is collateral and done for that purpose, be prepared that they can do this to you for years, but bear in mind that you can end it to be able to enlist the help of the government. Unfortunately that's the position I'm in right now, naively, as I mistakenly prolonged this litigation to their advantage by initiating a counter-claim against them, before understanding why they would go to such lengths, hiring two large law firms, spending so much money over complaints I just voiced. The lawyers they hire are just as corrupt. The used Epstein Becker Green to file a false claim against me stating that I was not allowed to speak with MVP, and that I spoke with them ("fact" is that MVP agreed to speak with me) , Even though I intend to win this case in court and on record, knowing now in retrospect that I naively?prolonged it. I will continue my counter-claim. I know that they will appeal a decision that is made in my favor to prolong it for what I expect to be another 2 years or longer with foreseeable delays due to the pandemic, but hopefully laws will change so that I can initiate a lawsuit against MVP on behalf of the Gov't.. I have the luxury of not backing down to them , as stated, as my wife is an attorney, who has finished raising our 5 children and is able to devote all of her time to fighting this company, not only for me but for all of us, especially since 3 of my sons went through the painstaking process of obtaining their medical degrees to follow in my footsteps but ended up graduating at a time when in effect, their ability to practice medicine has been taken away from them by the control and actions of businesses such as MVP Health Plan's administration, who have no medical training but have been successful at usurping the ability of doctors to make their own decisions regarding the care of their patients. In my case, this company has created a such a disruption to my practice that they have prevented my sons and others from practicing with me as planned.??

?As overwhelming as all of this is, I've tried to do my best to concentrate on the care of my patients which has been and always will be my priority, as Ido have the luxury of my wife handling this case for me, without putting her name down as attorney of record because they have also attacked my wife and tried to entrap her. These people, MVP the company and their representation if you deal with them, I can assure you, be prepared, they are out for blood.?I can assure everyone reading this, that I intend to make a positive change in our Healthcare System.?I am in this for the long haul, following the advice of counsel.?It will most likely take years but Rome wasn't built in a day and I assure you we will do whatever it takes to prove how this company has conducted business, refusing to share information with me and all of their providers, as they know if they had shared that information with me, they would have had to pay out a tremendous amount of money on follow-up services noted in hospital discharge summaries, consult notes from specialists, visits to ERs, urgent care centers, etc., which they had an obligation to provide me with but would not.?I informed them of this, in writing for years, through multiple routine audits they perform on all of us doctors. They are obligated according to CMS rules to review our records to see that we have a complete list of all that which I asked them to provide me with, informing them that I could not possibly obtain this information and keep a record of it unless they provided me with it, which they refused to do. This was what the complaint I voiced to the company, that they were not providing me with information, highlighting the failure to provide me with "Gaps in Care Reports" to which they responded with retaliation against me with has since snowballed into issues I now intend to prove are more noteworthy in terms of reporting.?

So, any physician enrolled with these plans, MMCPs especially MVP Health Plan, who reviews your records regularly, multiple times per year and concludes that they are complete without noting any deficiencies, should keep a record of every single thing you've handed in to them while participating and maintain that information should, for any reason, this plan retaliate against you as they've done to me for complaining about something. Other doctors have begun to speak up as well in light of the fact of what has become common knowledge now,?that our healthcare system and the decisions being made about our health has been taken away from the medical community and is now in the hands of politicians, large corporations and venture capitalists, whose actions infer that medical decisions are now being made with political influence and for financial gain to a large degree. According to the World Health Organization, America, who was once number 1 compared to all other countries in terms of the quality of healthcare systems, has and continues to fall below other countries, so others are speaking up, not just me, and we will continue to do so, so that the medical community regains control of our healthcare system.
