KEEP YOUR PERSONAL DATA SAFE IN THE DIGITAL ENVIRONMENT

Considering that a large portion of the Colombian population uses the internet, the Superintendence of Industry and Commerce issued the "Citizen's Guide – Recommendations for Keeping Your Personal Data Safe in the Digital Environment " which offers a series of useful tips to help users of digital platforms and mobile devices safeguard their information .

This guide is particularly divided into ten key areas, which include, but are not limited to: implementing encryption techniques to enhance security; strengthening the security of search engines to enable safer internet use; obtaining programs and mobile apps from their official websites or stores to ensure secure downloads; and backing up information by following the "3-2-1 backup rule" recommended by the United States Computer Emergency Readiness Team (US-CERT).

In this way, the guide promotes individuals' fundamental right to protect their data, reinforcing the stance that without security, there is no protection.



NEW INTELLECTUAL PROPERTY LAW IS APPROVED IN EL SALVADOR

The Legislative Assembly of El Salvador approved a new Intellectual Property Law, which will replace the Trademarks and Other Distinctive Signs Law and the 1993 Intellectual Property Law. This law created the Instituto Salvadore?o de la Propiedad Intelectual (ISPI), which will be in charge of managing procedures and mediating conflicts arising from these rights.??

The objective of the new law is to facilitate the protection of Intellectual Property rights , reactivate the economy, support small and medium entrepreneurs and promote investment in the country.??

Among its main changes are the renewal of trade names every 10 years, the extension of industrial design protection to 15 years, and the incorporation of new definitions for flavor, relief and texture trademarks. The law will enter into force six months after its publication in the Official Gazette.?

HARVARD UNIVERSITY FILES PATENT INFRINGEMENT SUIT AGAINST SAMSUNG


In another case involving technology developed by a university, on 5 August 2024, Harvard University filed a complaint against Samsung before the District Court for the Eastern District of Texas alleging patent infringement (available here ).? According to the complaint, the Asserted Patents (US Patent Nos. 7,973,189 and 7,560,581) “include, for example, novel processes and materials for deposition of thin films that contain cobalt or tungsten metals. Such films are essential to key components of numerous products such as computers and cell phones”.? The processes Samsung uses to manufacture products such as microprocessors and memory, which “are incorporated into computing, consumer, enterprise, networking, mobile, and automotive products, and are offered for sale, sold, and used throughout the United States”, use deposition processes and materials claimed by the Asserted Patents, and therefore, infringe them.?

FEDERAL JUDGE BLOCKS FTC RULE BANNING NONCOMPETE AGREEMENTS AMID LEGAL DISPUTES

A federal judge in Texas has blocked the implementation of a new rule by the Federal Trade Commission (FTC) that would ban noncompete agreements, questioning the FTC's authority to impose such restrictions.??

Judge Ada Brown, who had previously issued a temporary block, criticized the FTC for failing to adequately justify the near-total ban on these agreements, calling the rule "arbitrary and capricious."?

This decision adds to a series of conflicting judicial opinions in other states, where recent rulings have been issued both for and against the validity of the ban.?

The FTC will likely appeal the ruling, extending a legal battle impacting workers and businesses nationwide.
