MOSCAP's Contribution to Intellectual Property Protection and Copyright Management in Mongolia
Protection of exclusive rights for authors of musical works is essential when discussing intellectual property and copyright. In Mongolia, MOSCAP – the Mongolian Writers, Composers, and Publishers Association - has taken significant steps to promote copyright awareness and improve the working environment for underdeveloped organizations in the music industry.
MOSCAP has been collaborating with the Department of Intellectual Property since 2011, the Mongolian government's Implementing Agency, under a "Cooperation Agreement" established according to the Copyright Law. This agreement has undergone renewal in line with changes in the law, demonstrating MOSCAP's commitment to adapting to evolving copyright regulations and ensuring effective implementation. As the sole joint management organization in Mongolia with a cooperation agreement with the Department of Intellectual Property, MOSCAP has become a key player in protecting the exclusive copyrights of Mongolian and foreign musical works both domestically and internationally. In 2021, MOSCAP achieved a significant milestone by signing a cooperation agreement with Meta, enabling the licensing of music for popular applications like Facebook, Instagram, and WhatsApp. This collaboration ensures that the use of music tracks on these platforms is properly licensed and supports fair compensation for the creators.

MOSCAP's membership in the International Confederation of Societies of Authors and Composers (CISAC) since 2014 further strengthens its international presence and allows for collaboration and knowledge-sharing with other societies of authors and composers worldwide. CISAC, founded in 1926, is a prominent non-governmental and non-profit organization headquartered in France, with regional offices in Africa, South America, Asia Pacific, and Europe. With 227 member societies in 118 countries, CISAC represents more than 4 million artists globally. MOSCAP, as an active member of CISAC's Asia Pacific region, participates in important meetings, such as CISAC's spring-autumn regional gatherings, where reports are submitted twice a year. These interactions provide MOSCAP with valuable opportunities to contribute to the protection of copyright and share insights with international counterparts. MOSCAP's dedication to intellectual property protection and copyright management aligns with CISAC's mission of safeguarding the rights and interests of authors worldwide.
By actively engaging in meetings with local authorities, including the Mongolian Intellectual Property Office, MOSCAP stays up to date on regional developments and fosters a strong copyright environment within Mongolia. MOSCAP's role in protecting the rights of Mongolian composers and authors is instrumental in promoting a sustainable and thriving music industry. Through its cooperation with government agencies, participation in international networks, and licensing agreements, MOSCAP plays a crucial part in ensuring fair remuneration for artists and promoting the value of copyright in Mongolia and beyond.
