Back to you, lower courts The Supreme Court has tossed the hot potato of social media moderation back to the lower courts. This ruling is specifically related to the controversial laws in Texas and Florida that aim to curb perceived censorship of conservative viewpoints by major platforms (like Meta).?
The lawsuits argue that these state laws infringe on the First Amendment rights of the social media companies, which should not be compelled to host speech they do not agree with or to explain their moderation decisions. The lower courts had initially blocked these laws, but the Supreme Court’s latest move requires them to re-examine the cases more thoroughly before a final ruling can be made.
Justice Elena Kagan, writing for the majority, emphasized that the current record already shows that editorial decisions by platforms like Facebook and YouTube are protected under the First Amendment, (meaning Texas cannot interfere to ensure a diversity of viewpoints).
