Monday Morning Dispatch - 26 February 2024

Good morning, all,

Another action packed MMD this week. On the podcast we were delighted to be joined by our head of IT Dan Bell to discuss everything IT; including cybercrime and data protection. Daniel prepares a video on mistakes made in offer letters and whether organisations are contractually obliged to honour them.

There is still time to register your place at our equality and diversity seminar at the Leeds Rhinos and please do so by return or by emailing [email protected].

Help – I’ve been too generous!

This video explores the options open to an employer where an error has been made in the offer letter to a prospective employee (in this case in relation to a more generous salary than had previously been discussed).

IN THE NEWS

There have been lots of relevant employment law/HR updates this week.?

Employee constructively dismissed after complaint about ‘rude’ CEO

The Claimant alleged that she was subject to passive-aggressive, manipulative, and rude behaviour by Rhonda Alexander, CEO of a dating app and sister company. The Claimant informed the CEO of the holding company, Grahan Pullan, of her complaints, along with a multitude of others from numerous employees. She alleged that her complaint was met with both silence and isolating behaviour, including exclusion from board meetings and conversations, as well as continued bullying behaviour from Alexander. It was further claimed that false accusations by Pullan, Galina Ratcliffe, and Peter McNab of the company were levied against the Claimant as an attempt to receive her resignation, which came on 20 October 2021 after her suspension from the organisation on 19. After accusing the company of breach of contract and failing to deal with misconduct, leading to a deterioration of her physical and mental health, an Employment Tribunal found that she was constructively and unfairly dismissed.? A total of £97,361 was ordered to be paid to the Claimant for unfair dismissal, financial loss, injury to feelings and compensation for breach of contract.
