Lecturer unfairly dismissed for leaving work early awarded ￡50k
The Claimant began working for the College in 1997 and held an unblemished disciplinary record. In November 2020, during the Covid pandemic, the Claimant was suspended after the College alleged that he had cancelled morning coaching sessions, falsified the student register, left work early without permission, and had not provided allocated teaching hours the previous month. The claimant denied the allegations but was subsequently dismissed for gross misconduct in January 2021, which an appeal later upheld.
The Claimant had a longstanding agreement with the College that his “offsite time” would be scheduled on Friday afternoons so that he was able to leave early due to his three-hour journey home. The College also operated an informal practice whereby teachers would start the final lesson of the day during lunch so that they could finish early.
Despite the arrangements in place, the tribunal found that the College did not follow a fair disciplinary procedure in response to the allegations. It found that instead of considering the evidence, the College had “created a case to fit the desired outcome” and, had a fair process been followed, there was “no chance that the claimant would have been dismissed. At most, he may have received a warning.”
In the remedy judgment, the total award amounted to ￡53,400, comprising a basic award for unfair dismissal of ￡14,300 and compensatory award for loss of earnings of ￡39,000.
