Question. When do I need to provide an employee’s payslip if they have terminated?

Answer. As per Fairwork, pay slips have to be given to an employee within 1 working day of pay day, even if an employee is on leave or terminated. This can be done by emailing it to their personal email address or mailing it to their home address. Just make sure that the employee checks and updates their details before they terminate.

Newsbite - Unpaid pandemic leave available again

Employees covered by some awards can access 2 weeks’ unpaid pandemic leave from 15 July 2022 until 31 December 2022. This follows a recent Fair Work Commission decision to add the entitlement back into these awards.

Eligible employees can access up to 2 weeks’ unpaid pandemic leave (or more by agreement with their employer) if they can’t work because:

  • they’re required to self-isolate by government or medical authorities, or on the advice of a medical practitioner, or
  • of measures taken by government or medical authorities in response to the pandemic (for example, an enforceable government direction restricting non-essential businesses).

The leave is available in full immediately to full-time, part-time and casual employees – employees don’t have to accrue it.

Affected awards

The awards with unpaid pandemic leave entitlements available are the:

  • Aboriginal and Torres Strait Islander Health Services Award
  • Aged Care Award
  • Ambulance and Patient Transport Award
  • Health Professionals and Support Services Award
  • Social, Community, Home Care and Disability Services Award
  • Supported Employment Services Award.

Ombudsman or Commission – what’s the Fair Work difference?

We regularly have conversations with members, students and clients about the Fair Work Commission and the Fair Work Ombudsman.?It’s become apparent that the two are often confused, so here’s the scoop!

While both are responsible for making Australia a fair place to work, they play different roles and are separate organisations.


The Fair Work Ombudsman (FWO) enforces compliance with the Fair Work Act, related legislation, awards and registered agreements. FWO also help employees and employers by providing advice, education and assistance on workplace rights and obligations.

The Fair Work Commission (FWC) on the other hand is the national workplace relations tribunal. They help resolve disputes at work, create awards, approve enterprise agreements and review the minimum wage. People can lodge applications for unfair dismissal and general protections with them, as well as apply for orders to stop bullying or sexual harassment.

People often mix the two organisation up, which is fair.?We hope this helps to aid any confusion.

Newsbite: Updated FBT position on car parking benefits

With the introduction of TR 2021/2 many more employers will be subject to FBT on the provision of car parking to employees from 1 April 2022. Previously, shopping centre car parks and other similar facilities such as hospital car parks were generally not considered to be commercial parking stations for FBT purposes. As such, TR 2021/2 takes the view that a ‘commercial car parking facility’ can include the following:

  • Hospital
  • Shopping centre
  • Hotel
  • University

Airport A car parking facility may qualify as a commercial parking station even if the facility has another purpose other than providing all-day parking (e.g. it may also have a purpose of providing short term parking).

Although this will not have an effect until 1 April 2022, employers who were not previously subject to FBT on car parking fringe benefits should get ready and obtain advice on the best method to use to calculate the taxable value of these fringe benefits.
