Newsbite: Pay increases to SCHADS, Aged Care and Nurses Award

The full bench of the Fair Work Commission has announced a 15% increase to some workers covered by the SCHADS, Aged Care and Nurses Awards. These increases will be effective 30 June 2023.

You can find the draft determinations for each of the affected awards below, which sets out which workers and classifications are impacted, and what the new minimum wages will be:

Newsbite: Family and Domestic Violence Leave (FDVL)

If an employee has taken a period of paid Family and Domestic Violence Leave (FDVL), employers should record this on their pay slip in a way that makes the pay slip look as close as possible to how it would have looked if the employee had not taken the leave.

FDVL must be reported in STP to align with how you show these amounts on the employee's payslip as:

  • part of gross as an employee’s ordinary hours of work or;
  • a payment made in relation to the performance of the employee’s work, including (but not limited to) an allowance, bonus or a payment of overtime or;
  • upon request by the employee, as an amount paid for taking a period of another type of leave (other than a period of paid family and domestic violence leave).

You must continue to treat any amounts that would ordinarily be considered OTE as OTE for super guarantee purposes, and report information about your employee's super entitlements

Paid Family and domestic violence leave

As we know, employees are now able to access 10 days of paid family and domestic violence leave (FDV) in a 12-month period. Small business employers will have until the 1st of August 2023.

Key points to review in your system/procedures:

  • Employers cannot set up a FDV leave code. They will need to set up a leave code such as Other leave?
  • FDV Leave needs to be reported in STP Phase 2 as Paid leave type O
  • FDV should be set up with PAYG, Super, Leave accruals and Payroll Tax.
  • The employee should be paid the same amount that they would receive if they continued working
  • FDV balance should not be shown on the employee’s payslip
  • For all new employees they should now receive the updated Fairwork Information Statement - https://www.fairwork.gov.au/sites/default/files/migration/724/Fair-Work-Information-Statement.pdf
  • Discuss with HR on the process of how payroll will be notified of this leave.
