Mediation in Divorce


The goal of mediation is to help the parties in a problem reach a mutually agreeable conclusion by bringing a third party, or mediator, into the argument. During their meeting in a neutral setting, the parties can talk about their disagreement and consider different options with the mediator. It is encouraged for each party to be open and truthful about their viewpoint. The mediator can help the parties think about choices and alternatives that they may not have thought of because they are an impartial third party observing the conflict. The mediator is impartial since they do not have any prior biases and is neutral because they do not stand to gain directly from the terms of the settlement. Nowadays, marriage and family relationships are neither simple nor stable for a sizable part of adults and children. In India, where domestic violence and arguments are commonplace and affect one in every two people, many prefer to file lawsuits in court for things like divorce and other matters. However, this process can be time-consuming because there are several cases pending in Indian courts. Divorce mediation is the least confrontational option, therefore divorcing spouses should weigh their options constructively and progressively. Divorce has increased greatly in frequency as a result of the intensifying family issues. As a result, everyone who is concerned is looking for a workable solution. Divorcing couples are aware that ending a marriage does not mean the end of all aspects of it; divorce dissolves the formal agreement between a husband and wife, but it also destroys the family unit built on that union. Usually with the consent of the attorneys on both parties, the court appoints mediators. Mediators reappear in a multitude of forms. Many of them are lawyers who work as professional personal mediators. About ninety percent of the time, they do away with the need for a jury trial. A number of them are retired lawyers or non-lawyers who have received mediation training from Dispute Resolution Services. It's a process wherein the parties and their lawyers consent to settle any disputes amicably, honestly, and morally—without resorting to combative tactics in court or outside of it.
