Hangley Aronchick has prevailed in a crucial constitutional challenge to Pennsylvania's escheatment law. Shareholders John Summers and Matthew Hamermesh and associate Eitan Kagedan represented the Pennsylvania state treasurer in a federal class action lawsuit. The case centered on the constitutionality of Pennsylvania's law governing unclaimed or abandoned property. In this landmark victory, the team successfully argued that Pennsylvania's escheatment law does not violate the Takings Clause of the U.S. Constitution. The court, in a 13-page memorandum opinion, affirmed our position, citing precedent and holding that the state's retention of abandoned property did not constitute a taking that necessitates compensation from the state.
