Welcome to the May 2024 edition of the AI & Partners Newsletter.? Our customised monthly newsletter by AI & Partners updating you on the latest developments and analyses of the proposed EU Artificial Intelligence Act (the “EU AI Act”). ?To begin, this month marks the first month following The Council of the European Union’s approval and the EU AI Act’s publication in the Official Journal of the European Union, its entry into force is expected later this month. A both historic and monumental moment to ca off over three years’ of legislative developments.

With the EU AI Act’s imminent entry into force as well as the two-year mandatory compliance implementation period, businesses are now being forced to start – and continue – their preparations in EU AI Act readiness. This issue examines a range of matters things from formal publication of the official text to approval from The Council of the European Union. Our objective is to remain ahead of the curve to keep you informed.

What’s the latest with the legislative process?

  • MEPs Raise Inquiries Regarding AI Office: According to a report by Euractiv's Tech Editor Eliza Gkritsi, three members of the European Parliament have raised questions with the European Commission regarding the recruitment procedures for the AI Office. This office is tasked with enforcing the EU’s significant technology law. Specifically, Svenja Hahn from Renew Europe, Kim van Sparrentak from the Greens, and Axel Voss from the European People’s Party, who served as shadow rapporteurs for the AI Act, are seeking clarification on the selection process for the office's leader and strategies for attracting talent in a highly competitive global market. Despite the law being passed in March, the appointment of the office leader remains pending, even though enforcement aspects are scheduled to commence six months after the law's enactment. Dragos Tudorache, rapporteur for the legislation, has also expressed concerns regarding the transparency of the process. Initially proposed by some MEPs as an independent entity, the AI Office was integrated into the Commission as a compromise to ensure regulatory coherence and facilitate the development of the digital single market.?
  • Call for National AI Regulators by Governments: As reported by Senior EU Policy Reporter Cynthia Kroet at Euronews, the European Commission is encouraging national governments to appoint AI regulators as part of the implementation of the AI Act, slated to commence by the end of this year. Roberto Viola, Director General at the Commission's digital unit, announced that letters will be dispatched to member states urging these appointments, with a deadline of 12 months for their establishment. These regulators will constitute the AI Board, tasked with standardizing the approach to AI regulation across the EU. The Commission aims for the Act to be fully in effect by June, with prohibitions on certain practices becoming effective by the year's end. Recruitment for positions within the AI Office has commenced, with plans to onboard approximately a hundred staff members, some of whom will start their roles this autumn. However, the selection process for the head of the AI Office will only commence upon the full approval of the Act.

What do the latest analyses state?

  • India's Focus on the AI Act: In an opinion piece, Shweta Bharti, the Managing Partner of Hammurabi & Solomon Partners, along with Pranshu Singh, an Associate at the firm, examined India's approach in comparison to the EU's Act. Bharti and Singh highlighted the global implications of the EU's legislation, particularly for India, which is already in the process of formulating its own responsible AI framework. They discussed the concept of the 'Brussels Effect,' which denotes the EU's regulatory influence extending beyond its borders, affecting trade and technology cooperation worldwide, including India. The authors pointed out potential compliance burdens for Indian companies serving EU clients and emphasized the need for alignment with certain AI policies to maintain smooth trade relations. They also suggested that this alignment could foster collaboration in the responsible development and deployment of AI, facilitate data exchange, and offer policy insights from EU implementations for effective AI regulation in India.
  • Addressing General-Purpose AI: Thanos Rammos and Richard Gl?ser, Partner and Associate at the law firm Taylor Wessing, summarized the provisions regarding general-purpose AI (GPAI) in the AI Act. They outlined the classification of GPAI into standard, openly licensed, and those posing systemic risks, along with the accompanying documentation and compliance requirements. The authors discussed the enforcement mechanisms overseen by the new AI Office and highlighted the intersection of GPAI regulations with existing laws such as GDPR and intellectual property laws. They noted that the Act's GPAI rules would come into effect 12 months after adoption.
  • Lessons for the US: Samuel Hammond, Senior Economist at the Foundation for American Innovation, cautioned against blindly emulating the EU's AI Act in an article for City Journal. He critiqued the Act's risk-based approach, arguing that it overly focuses on equity issues rather than catastrophic AI risks. Hammond commended the provisions related to general-purpose AI but raised concerns about unrealistic demands and potential fines deterring US developers. He advocated for a more nuanced approach, focusing solely on catastrophic risks and delaying broader regulation until a clearer understanding emerges.
  • Additional Perspectives on the AI Act: Maria Villegas Bravo, EPIC Law Fellow, evaluated the strengths and weaknesses of the AI Act in an article categorizing them into "The Good, The Bad, and The Ugly." She praised certain aspects of the Act while critiquing others, suggesting that the US should adopt a different approach based on comprehensive privacy legislation. Furthermore, Thomas Gils at The Knowledge Centre Data & Society outlined best practices for deepfakes and chatbot transparency under the AI Act, based on a project exploring compliance requirements. Tech experts from various sectors, as reported by Pascale Davies at Euronews, offered mixed perspectives on the Act's passing in the European Parliament, highlighting both commendations and concerns regarding its effectiveness and impact on competitiveness and fundamental rights.?
  • Economists' Perspectives on the AI Act: The Forum for the Kent A. Clark Center for Global Markets conducted a survey among economics experts to gauge their views on the AI Act. Respondents were asked two key questions regarding its potential impacts. Regarding its effect on European tech firms, opinions varied: 4% agreed it would put them at a disadvantage, with an additional 2% strongly agreeing, while 2% strongly disagreed and 16% disagreed. One economist raised concerns about regulatory complexity potentially driving entrepreneurs away from the EU, while another mentioned the possibility of a "Brussels effect," where EU regulations could influence global adoption by tech firms. On the claim that the Act could enhance research and innovation, responses were mixed: 24% agreed, while 6% disagreed and 2% strongly disagreed. One expert highlighted that clear regulations could reduce uncertainty and foster AI system development, while another pointed out the potential increase in regulatory burden leading to decreased innovation, particularly in certain sectors like automotive and large-scale machine learning.
  • Interview with Drago? Tudorache: Melissa Heikkil?, Senior Reporter at MIT Technology Review, conducted an interview with Drago? Tudorache, a key figure behind the AI Act. Tudorache, one of the Act's lead negotiators in the European Parliament, shared his journey from initial interest in AI sparked by reading Nick Bostrom's book Superintelligence in 2015 to his active advocacy for AI regulation upon his election to the Parliament in 2019. He navigated the Act through challenging negotiations, addressing issues ranging from tech company lobbying to conflicting interests among EU member states. Despite criticisms from civil society for perceived human rights shortcomings and from industry for potential overregulation, Tudorache views the final compromise as a result of standard political processes.
  • Critique of the AI Act's Impact on Fundamental Rights: Liberties, European Center for Not-For-Profit Law (ECNL), and European Civic Forum (ECF) jointly analyzed the AI Act's implications for fundamental rights and civic space. They argue that the Act's expedited finalization led to significant gaps and legal ambiguities, leaving much to be determined through subsequent Commission actions. These organizations emphasize the importance of civil society, especially from marginalized groups, in the Act's implementation and enforcement phases. Identified flaws include gaps in prohibitions, reliance on self-assessment by companies, weak standards for assessing fundamental rights impact, the potential for AI in national security to bypass rights protections, and insufficient provisions for civic participation in implementation.?
  • Clarity Issues with AI Definition: In a blog post, Tervel Bobev, Researcher at the Centre for IT & IP Law, expressed concerns about the ambiguity surrounding the definition of AI systems in the Act. Despite the Act's attempt to define AI systems, Bobev argues that the language remains vague, particularly regarding the extent of required autonomy and its distinction from mere automation. This lack of clarity suggests that the definition may require further interpretation through case law and regulatory guidance to ensure effective implementation.?
  • A critical opinion. On Thursday, the Parliamentary Assembly of the Council of Europe (PACE), welcomed the completion of the draft Framework Convention on Artificial Intelligence, Human Rights, Democracy, and the Rule of Law, crafted within the Council of Europe, but expressed concern about its unequal treatment of public and private actors. PACE urged member states to apply the convention’s provisions fully to private entities and suggested amendments to ensure international human rights law compatibility. The convention, set to be the first international treaty on AI, involves negotiation among Council of Europe member states, the EU, and non-European states like the US, Japan, Canada, and others.

Fundamental Rights Impact Assessments (“FRIAs”) are one of the proposed accountability tools in the upcoming European Union Artificial Intelligence (“AI”) Act (the “EU AI Act”).
