Massive Criminal Corruption at the University Hospital (UHWI) involving Minister Dr. Christopher Tufton, HR Director, CEO, Chairman and Lawyers.

The corruption include the filling of the hospital CEO position to Mr. Fitzgerald Mitchell in a highly unlawful manner by the corrupt Senior HR Director Duane Nelson and the Board of Management headed by Chairman, Patrick Hylton, and the criminal refusal of the hospital to make payment of interim court cost to me. All of which is well known to the Minister of Health, Dr. Christopher Tufton who is supporting and part of the corruption at the hospital as he refused to take do anything. Also involved in the corruption are; former hospital Legal Officer Dr. Peter Glegg, present legal officer Kimani Brydson, and Myers Fletcher and Gordon law firm Lawyer, Matthew Royal.

The post of CEO became vacant from November 1, 2022. I submitted my first application for the post on November 10, 2022, to the HR Director Mr. Duane Nelson by email and he acknowledged it. Up to January 2023 I did not hear anything about my application for the job, so I wrote the then Chairman of the Board of management and he replied to me in no uncertain way by email and hard copy that the post will be advertised soon by Caribbean Jobs and that I should look out for it and resubmit my application. That was a lying and misleading position by that Chairman. The post was never advertised by Caribbean Jobs, but instead it was advertised in the Sunday Gleaner. Having learnt that the post was advertised in the Sunday Gleaner in April 2023 from Mr. Nelson himself, I immediately re-submitted a new application in response to the Gleaner advertisement, clearly explained the misleading information given to me by the Chairman and I also made known my first application made November 10, 2022.

Up to February 2024 I had not heard anything about my application for the post of CEO and when I checked it was still not filled. Mr Fitzgerald MItchell was the acting CEO. In the same February 2024, I wrote to the Board of Management through the new Chairman, Mr. Patrick Hylton asking why my application was not considered for the post, having all of the qualifications and experience competencies for the job. To date I have not heard from the corrupt Chairman, Patrick Hylton. In addition about a month after sending the letter and got no reply from the Board, I made a written request to Minister Christopher Tufton asking him to investigate what is happening to my application why I have not heard anything about it, and I also copied the letter to the Board, to him. To date I have not heard anything from the corrupt MInister Christopher Tufton also.

I recently uncovered that Mr. Fitzgerald Mitchell was appointed into the post of CEO. Now here is the corruption and unlawful situation that the hospital put itself into. I had the privilege of studying HR courses at UWI which I did, in my business degree and a lot of my connections here are HR experts and anyone else can tell me if I am wrong. If Mr. Mitchell was qualified and have the competencies for the post he should have been promoted into the post from November 2022 without any advertisement of the post. If there was no promotion the post should have been advertised internally first to see if anyone interested in it, and apply for it. All of that should have been done before any external public advertisement of the post made. Having advertised the post externally public in the Sunday Gleaner of April 2023, the hospital cannot just dumped the qualified applicants who responded to the advertisement, and now just corruptly squeeze in your own Mr. Mitchell into the post. That is a clear corrupt and unlawful misrepresentation of facts, among several other unlawful damages.

I have sent on July 1, 2024, an email to the corrupt HR Director Duane Nelson requesting answers to the following questions, but to date he has not replied,

The hospital does not seem to have an Information Officer so I seek the following HR information about the UHWI from you.? Also in light of the fact that the Hospital is partially government run.?

1.? Does the employment of person for position such such as the Chief Executive Office (CEO) falls under the Ministry of Public Service employment regulations?

2. What is the educational qualification requirement for the CEO position??

3. What is the educational qualification of the current CEO of the hospital, UHWI?

4.? When was the current CEO appointed into the position of CEO??

5.? Why was my applications already there that you know of for the CEO post not considered??

Clearly Mr. Duane Nelson is hiding the corruption in the filling of the hospital CEO post. For which he is the biggest corruption in the matter as HR Director. All employment positions at the hospital falls under the Ministry of Public Service employment regulations, for which he has carried out major breaches of the employment regulations as HR Director. As HR director he has a major duty of responsibility to ensure that the employment of the CEO follows the proper employment regulations, regardless of what the corrupt Board of Management wants to do otherwise. Clearly the employment of Mr. Fitzgerald Mitchell as CEO cannot be made transparent.

On another issue I have had to sue the hospital on two previous occasions for failure to provide me with my requested medical reports for treatment I received on two consecutive occasions as a patient. On both occasions I was told that my medical records cannot be found.. The medical reports are in regard to a court case, so clearly my medical records have criminally disappeared from the hospital, in 2019 and 2021 under the CEO leadership of Mr. Kevin Allen. Mr. Kevin Allen is also sued with the hospital. Interestingly Mr. Fitzgerald Mitchell was also working there as an Administrative Officer who could not help to resolve the criminal missing of my medical records. What different can he do now as a CEO? To date the reports cannot be made available to me.

The two cases are in progress before the Supreme Court. Some months ago the then hospital legal officer Dr. Peter Glegg and their big representative law firm, Myers Fletcher and Gordon, lawyer Matthew Royal insisted on going to Mediation without making a proposal to me for settlement before. I told them it was a total waste of time and expense going to Mediation if they cannot make the proposal known to me before so I could see if it is anything worth going there for. The cost for Mediation is $25,000.00 for each party. I told them I would not be paying that $25,000.00, since they cannot make a proposal known before. Lawyer Matthew Royal proudly told the court that the hospital will pay the total $50,000.00. Fine I went to their mediation at no expense to me.

The hospital Lawyer Dr, Peter Glegg and Matthew Royal came to the Mediation with the most insulting offer, $150,000. I refused it bluntly. Peter Glegg then made a final offer of $500.000. I refused that too, because it could not even cover legal cost for two major lawsuits, much less to compensate me for the damages suffered. Dr Peter Glegg was most corrupt in making those insulting offers, nothing near to the reasonable figure I suggested. While at the same time the hospital is pouring out millions to pay the law firm Myers Fletcher and Gordon, for just going to court to do nonsense, instead of using the money to compensate the victim of the damages in a reasonable way. The cases went back to the court.

One of the cases is already gone in my favor. Default judgment has been granted to me from February 2024, and the date set for assessment of damage. The other is in progress, of which I have nothing to fear as my evidences are solid. Along with the Default judgment in my favor the judge awarded me $50,000 for cost. Days later I did not get a reply from him either, and only after sending two reminders he replied to me on July 9, 2024. stating that he has no knowledge of the cases. I provided him with details of the cases and the money owing to me. Clearly former legal officer, Dr. Peter Glegg departure from the hospital was not a pleasant one to not update the legal officer. Possible because I had put full detail of his unacceptable unprofessional behavior in that letter to the Board of Management in February.

Secondly, from February 2024, the Supreme Court of Jamaica awarded me $50,000.00 in cost for one the cases that I have against the hospital.? For more than a month now I have written to the Board of Management and the CEO about the payment of this money to me.? ?However to date no one replied to me. I have since last week written to the new Legal Officer Mr, Kimani Brydson and provided him with the necessary information, as was told that he was not aware of the matter.? However to date I have not had any words on when the money will be paid to me. This is a very disrespectful behavior from the Board of Management and the CEO of the hospital.?

Clearly there is a major corruption taking place at the University Hospital of the West Indies (UHWI) involving the Minister of Health, Christopher Tufton, Current CEO, Mr, Fitzgerald Mitchell, Senior HR Director Mr Duane Nelson, Chairman of the Board of Management, Mr Patrick Hylton, past legal officer Dr. Peter Glegg, present Legal Officer, Mr. Kimani Brydson and Myers Fletcher and Gordon Lawyer, Matthew Royal.

Minister Tufton has a constitutional duty to put in a reputable Board of Management at the hospital and to give proper guidance to them to do things in the right ways, following proper procedures. The Minister failed in his constitutional duty to do that. What due diligence was done on Mr. Patrick Hylton after being recently fired from NCB Bank as CEO? What credibility is Patrick Hylton supposed to give to what is supposed to be one of the most reputable institution in Jamaica and the Caribbean, UHWI?? Certainly appointing Mr. Fitzgerald Mitchell as CEO after the post was publicly advertised is grossly unlawful. The Minister spent his time doing PR job instead of his constitutional duties as a Minister.

Newly installed CEO, Mr. Fitzgerald Mitchell and Legal Officer Kimani Brydson have already committed an unlawful act when they refused reply to my letter and have the matter dealt with professionally. Clear breach of duty of care. Instead they are trying to rob me of $50,000 like common criminals! Myers Fletcher and Gordon Lawyer, Matthew Royal is part of the corruption as he may have given instruction to the hospital not to pay the money. As he had told me in the early stage that no money will be paid until the end of the case. While Myers Fletcher and Gordon law firm is sucking millions out of the hospital of taxpayers money, they are digging a deep grave for the hospital. Myers Fletcher and Gordon is not a court of law. The money becomes due for payment from the date the order was made and further confirmed by the perfected Formal Order. It accumulates interest as time goes by.

Senior HR Director Duane Nelson is a big corruption at the hospital as he is in clear breach of HR policies and procedure regulations, in the appointment of Mr. Fitzgerald Mitchell, after the post was made competitive from the public gleaner advertisement. As is quite clear from his refusal to answer the questions for transparency in a public organisation. That is an unlawful breach of duty of care. Former Legal Officer Dr. Peter Glegg should be held responsible for the wasting of that $50,000 at Mediation, and all of those millions being paid to Myers Fletcher and Gordon law firm, instead of helping to fix the problems at the hospital and compensate the victim in a reasonable way. Look at that, they have so much of taxpayers money wasting and they cannot pay me my interim payment of $50,000. What a disgraceful situation Minister Christopher Tufton is promoting at UHWI !!

I applying for the job of CEO as it has nothing to with the court cases,. The court cases are as a result of being a patient at the hospital and not as a worker. They however turn it into an unlawful malicious and vindictive action against me. I applied for the job because I am fully qualified and competent for the job and would be probably the most qualified and competent CEO that hospital ever had. I even made an offer to the corrupt Board of Management in letter of February 2024, that if given the job of CEO, I would consider compromising the court cases because I would get the chance to fix the problems at the hospital. Now the hospital have more lawsuits coming.

My qualifications and competencies: Masters degree in Public Health - Medical Epidemiology and Health Management and Administration with DISTINCTION, Double major Business Management and Accounting degree, Qualified and Experienced Medical Technologist, Qualified and Experienced Educator/ Lecturer, and Qualified and Experienced Hospital Administrator.

What is the qualification and competencies of Mr. Fitzgerald Mitchell that is in hiding, Duane Nelson, Patrick Hylton and Minister Christopher Tufton????
