New FLSA Rule, March 11th

On March 11th, the U.S. Department of Labor implemented a rule that will greatly benefit workers across the country. Under the new FLSA Worker Classification Rule, it will now be a lot easier for workers to gain status as employees over independent contractors. Misclassification of workers as independent contractors has become a significant issue in recent years, leading to denials of minimum wage, overtime pay, and various other protections.

What does this mean for you as an employer?

Ensure that you’re compliant with the new regulations: This new rule requires you to analyze “totality of circumstances” when classifying workers. When deciding whether a worker is an employee or independent contractor, you will need to take all of the following factors equally into account:

  • A worker’s level of control over their work
  • A worker’s opportunity for profit or loss
  • Degree of skill required for a worker’s role
  • A worker’s level of permanence at their job
  • How critical the worker’s role is to your business

Each factor must be assessed as part of a holistic whole. Failure to do so may result in worker misclassification, which can lead to legal and financial consequences.

Roxanne, our dedicated Payroll Manager at Brand’s, recently celebrated her two-year anniversary with the company. Roxanne plays a pivotal role in overseeing a wide array of responsibilities that keep our payroll operations running smoothly and efficiently. To mark this milestone, we sat down with her to delve into her experiences, the evolution of her role, and the innovations she's spearheading within our team.


What does your role entail?

My responsibilities include creating training programs to upskill our team, process improvement, assessing KPIs, and addressing any client support needs.


What was your role when you started?

I began with training under Amy, learning about different laws and our systems. I then helped with new hire training and developed the training program with Devorah, who mentored me into this role.


What would you say is your most rewarding aspect of working with Brand’s?

I get a lot of job satisfaction from consistently moving forward. We always try and find better solutions, and that continuous improvement is a great motivator.


What are you looking forward to at Brand’s?

I'm excited about the projects we're working on, especially giving clients more independence with PayDeck 2.0, which opens up growth opportunities for our team.


What's one unexpected thing you've learned along the way?

I think forming the bonds that I did with people across the world from me being so far.


What makes Brand’s stand out from competitors in terms of services we offer?

The way that we're constantly trying to make things easier for our customers; through the software we create as well as our day-to-day support.

What do you enjoy doing outside of Brand’s?

I love gardening. I also enjoy spending time with my two dogs, and working on home DIY projects.


Is there anything else you want to share about your experience so far with Brand’s?

I love that every member of my team, I either trained or was trained by—so each of them contributed to where I am today.
