Man Accused of Outraging Modesty of Woman Entitled To Bail : HC

In a recent case of?Sanauddin v State of Assam [2022] GCtR 220 (Gauhati)?on?24 January 2022, the person was accused of offences registered at Mererchar P.S. Case No.137/2021 (corresponding to GR Case No. 1527/2021) under Sections 120(B)/498(A)/354/307/511 of the IPC. He has approached by way of an application under S.439 of Code of Criminal Procedure, 1973 ["C.Cr.P."]

While it was noted that "on perusal of the case diary, it appears that there is prima facie abundance of incriminating material against the accused petitioner subject, of course, to final outcome in investigation" such accused was allowed to be released on bail subject to certain conditions described in the Order. One of the conditions so described in the Order is that "the accused/petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Police Officer or the Court".
