IT MAJOR IN BENGALURU TERMINATING IN HUNDREDS
One of the IT major with its head quarter in Bengaluru?is ?orally asking around 600 of its Engineers and Managers who have worked for more than 15 years to resign within next 48 hours on the ground that they have not moved to the next band.
Two of its managers spoke to me for advice just now after reading my Article in Linkedin on Forced Resignation. They said as under.
1) There is no condition in the contract of employment that they have to move to the next band failing which they will be terminated.
2) Moving us to next band is the management discretion and we have no control over it.
3) We have never ever refused to move to the next band.
4) The management never ever offered ?us to move to next band. ?
5) All through these years our performance has been quite good.
6) The company is offering us just two months severance pay even though we have worked for more than 15 years.
7) IN THIS CONTEXT SHOULD WE RESIGN OR ALLOW THE MANAGEMENT TO TERMINATE US.
8) What is our chance of winning if we go to court of law.

MY ADVICE TO THEM
1) Those who can get employment elsewhere can resign.
2) Others can seek at least one year service extension so that alternative employment can be found during this period.
3) If the employer is not willing to extend the service by one year ask for one year severance pay.
4) If you do not resign, the employer may terminate you?and thereafter if you try for other companies, your employer will giveadverse reference report.
5) Even though you have a strong case to win in the court of law, you may have to wait at
least five to ten years to get the verdict ?in our legal system.
6) Career adversities are common in private sector. Never loose hope. Never loose peace of mind.
7) Employment and Salary are just less than 1% of what we are. 99% is our life which we love.
