Looking Back

I've been struggling for the last 20 minutes to develop a catchy title for this article. With baby number two less than three weeks away, I'm reminded how fast time flies. Whenever I take Mia to breakfast, inevitably, someone says, "cherish these moments... they'll be gone before you know it." How true that is.

This morning I looked at her, and I couldn't believe that she was the same seven-pound potato that we brought home from the hospital in November of 2021. She's so close to walking, loves to swim, is obsessed with her doggies, and is always up to trouble. She gives me a reason to be better. Raising her makes my other accomplishments look easy. Last year I:

  • Achieved five years of sobriety
  • Made the tough decision to leave some of my BFaW (best friends at work) and try something new
  • Fully embraced the world of eDiscovery, becoming an expert in our product and making incredible connections at DISCO
  • Bought a new boat
  • Mentored and coached several new sales reps

Forging Ahead

2023 is shaping up to be an incredible year, too. Abigail Baxter has done an incredible job packing my schedule with meetings. I've built strong relationships with our clients and prospects to benefit everyone. I'm committed to achieving industry certifications like CEDS—having the best technology on the block doesn't hurt, either.

Given the shakeup in the tech world, I'm grateful to have the opportunity to keep making a positive impact at DISCO and in the legal space. Together, we can accomplish anything.

News

Litigation / eDiscovery

  • ComplexDiscovery.com put together its 2022-2027 industry outlook for eDiscovery. They anticipate eDiscovery software to grow at a CAGR of 12.72% from $4.78B in 2022 to $8.70B in 2027. They point out that the on-premise solution market share will fall from 45% in 2022 to 27% in 2027. This is no surprise, as even the most conservative law firms are considering a move to the cloud.   • Reuters released its 2022 eDiscovery wrap-up as well, pointing out key sanctions for failing to preserve and produce relevant ESI. One case imparticular that they mention is Red Wolf Energy Trading, LLC v. Bia Capital Mgmt., LLC, _ F. Supp. 3d _ , No. 19-10119, 2022 WL 4112081 (D. Mass. Sept. 8, 2022). While the article points out the many delays in producing documents, the straw that broke the camel's back was the defendants' failure to produce Slack messages, including "smoking gun" communications. The court noted that "At a minimum, [defendants'] decision to utilize an unpaid novice in Kazakhstan to conduct its search for Slack messages, rather than an experienced vendor in the United States at a modest cost, ... was in reckless disregard of [their] duties under Rule 26 and to obey court orders." Domain Names

  • Elisa Cooper , head of Marketing at GoDaddy Corporate Domains , released her 2022 corporate domain name management survey results. 56% of survey respondents worked at companies with 3,000+ domains, while 29% were from companies with 10,000+ domain names. GCD's survey shows that 40% of domain name portfolios are managed in the legal department, followed by IT at 33%. Also worth noting, over 40% of respondents are considering a move to a new registrar. GDPR remains top of mind, as well as Blockchain domains. You can read the press release here and GCD's article here.
  • Mark Cuban lost the domain name GoBlue.com to 'The Regents of The University of Michigan' in a cybersquatting dispute. Cuban bought the domain name as a joke, pointing the domain to a website selling Indiana University merchandise (Cuban's alma mater.) Ultimately, the domain name was transferred to Michigan.
