Are there limits to your right to own a real estate property anywhere in Nigeria?

As a Nigerian citizen, you have the right to own a real estate property anywhere in Nigeria notwithstanding your indigeneity.

The constitution makes it abundantly clear in section 43 of the constitution which states that:  

Subject to the provisions of this Constitution, every citizen of Nigeria shall have the right to acquire and own immovable property anywhere in Nigeria. 

Immovable property refers to lands, houses and buildings. So it seems clear that citizens can own immovable properties anywhere in Nigeria.

One of the limitations to the right of ownership is contained in section 44 which gives the government the power to compulsorily acquire a property for the benefit of the citizens. However, during any compulsory acquisition compensation must flow towards the person whose property has been acquired.

Also, the government as the owner of all lands may commit specific portions for public use such as the building of health centres, secretariats, police stations, schools etc. You cannot acquire any of these committed portions of land without the express approval of the government.

Owning a real estate property anywhere in Nigeria involves initiating a property acquisition procedure. An acquisition can either be through purchase or other means recognized under the law. Also, the consent of the governor of the state where the land is situated must be sought and obtained. You are also expected to pay the associated taxes and register your interest in the property.
