Thank you for the below response?of the Swiss Federal Prosecutor's Office, confirming that serious unresolved crimes dating back to 2013 (including proven OFFICIAL BLACKLISTING, defamation by the Swiss Federal Representative on the Board of the International School of Geneva, Pascal Emery and untold alleged legal, financial, judicial and medical corruption) will not be investigated by the Federal Prosecutor’s Office, as has been the case with the Geneva Cantonal Prosecutor’s Office.?

I am hereby appealing the decision of your office, which has referred to Articles 23 -26 of the Swiss Federal Criminal Procedure Code.

1.???? ARTICLE 23 (j):?the offences in Titles Eighteen and Nineteen insofar as?they are committed by a member of an authority?or an employee of the Confederation or against the Confederation;?Crimes have irrefutably committed against me by public officials INCLUDING THE THEN SWISS FEDERAL REPRESENTATIVE ON THE BOARD OF THE INTERNATIONAL SCHOOL OF GENEVA, PASCAL EMERY, and a SWISS PUBLIC OFFICIAL WHO HAS OFFICIALLY JUDICIALLY BLACKLISTED ME ON AUGUST 22ND 2013.?Both Pascal Emery and Francoise Markarian (lawyer of the International School of Geneva) are members of the Geneva Judiciary.
2.???? ARTICLE 24 (1 a), with reference to organised white collar crime (1a)?have to substantial extent been committed abroad. Records are held by at least Sussex Police,?the Geneva Ministère public, Sussex Police, the UK Foreign Office, the Swiss Federal Police, the Geneva Police, the Irish Foreign Office, Her Majesty's Prisons & Probations Services, the Irish Police and Irish Prison Services and there is an ongoing criminal investigation into the agonising death of a family member in Mauritius, which has also prompted complaints about the UK Foreign Office;
3.???? ARTICLE 24 (1b)?with reference to organised white collar crime, crimes?have been committed in two or more cantons with no single canton being the clear focus of the criminal activity. I contend that numerous crimes have been committed against my family, particularly in Vaud and Geneva - which have also extended to at least St Gallen and Zurich by a confirmed financial fraud;
4.???? ARTICLE 24 (2b) with reference to organised white collar crime?no cantonal criminal justice authority is dealing with the case. The Geneva Cantonal Police has apparently referred criminal complaints to the Geneva Prosecutor's Office, and I have addressed these complaints to at least? the Geneva Procurer-General,?Olivier Jornot and to and Prosecutor Mme Judith Levy Owczamczak?
Even though the Geneva Police has confirmed that my allegations (including BLACKLISTING and legal corruption) are subject to ongoing criminal proceedings,??Prosecutor Mme Judith Levy Owczamczak, apparently responsible for this file?(P/17792/2021)?, is prosecuting me over the later and allegedly false and vexatious criminal complaints of the International School of Geneva - instead of prosecuting my complaints and updating me on ongoing proceedings.?
II ?Formal complaint about Geneva Procurer-General, Olivier Jornot and Prosecutor Mme Judith Levy Owczamczak for numerous reasons already outlined in the evidence provided to your office and included in the attachments. I refer to my letter of complaint to the Geneva Cour de Justice about Olivier Jornot and my tens of submissions to your?office at this?email address since 2018, also supported by the following articles:

The Charles Léopold Mayer Foundation) and the Whistleblowing International Network (WIN) conducted an in-country mission in Switzerland in March 2022, meeting with whistleblowers, lawyers, NGO practitioners, journalists, and academics in Geneva, Lausanne and Bern. The resulting report is attached and I believe it reflects a few of my challenges, some of which are summed up in this summary (page 2):?

In Switzerland, whistleblowers who suffer retaliation fight alone against their employers, but also against their lawyers, insurance companies, and the legal system. Dismissals, criminal and civil sanctions for breaching confidentiality, moral harassment, mobbing, discrimination, and pressure, are?only some of the actions taken against whistleblowers. Because there is no proper legal protection,?(4?)?there is also no organized civil society support for whistleblowers before, during and after someone?reports or discloses information nor any concerted civil society movement, such as exists in France?today, to advocate for the protection whistleblowers, despite the efforts of some very committed?organisations (see more later).

It seems to me - rightly or wrongly - that:
1.???? Well-connected ‘offenders’ and corrupt officials are safer than children and the families whistleblowers in Geneva;
2.???? Certain public officials enjoy impunity;
3.???? Wealthy well-connected 'offenders' enjoy impunity;
4.???? Victims of the above have no victims' professional, legal, data, judicial or human rights. At least the Swiss Criminal Procedure Code, LAVI and LIPAD do not appear to be respected;
5.???? It is impossible to achieve independent legal representation if the alleged perpetrator is a cantonal official or a well-connected 'offender';
6.???? Whistleblowers are arbitrarily subjected to SLAPP proceedings?- supported by the Geneva Public Prosecutor;
7.???? That?is officially felt?that the role of? Olivier Jornot (who belongs to the same political party as Prosecutor?JUDITH LEVY OWCZARCZAK)?in matters of management and oversight should be restricted;
8.???? That there is no oversight or regulation of lawyers in Geneva, perhaps best illustrated by my letter to JUDITH LEVY OWCZARCZAK regarding Jacqueline Mottard, as well as evidence relating to other Geneva lawyers.

III ?European Court of Human Rights

Given that I am not receiving any data relating to my criminal complaints, dating back to 2013, duly transmitted to JUDITH LEVY OWCZARCZAK by the Geneva Cantonal Police and given that my family has been officially judicially blacklisted my family August 22nd 2013? and especially given that alleged crimes against me include by Geneva Cantonal Officials and have been committed across several cantons and jurisdictions, if the Swiss Federal Prosecutor’s Office also refuses to respect the victims’, data, professional and human rights of my family, then I presume that I can escalate this case to the European Court of Human Rights, whilst continuing to live in fear and distress in Geneva?

I understand that now I have exhausted all processes in Switzerland, and because – after almost a decade of judicial blacklisting - I remain fearful for the safety and well-being of my British/Irish family internationally (because of the apparent sphere of influence of those implicated in this tentacular case, I can contact the press without fear of further judicial reprisals.

Please could you kindly confirm the following:

1.???? That you have received my appeal against the decision of your office.
2.???? That you have received my formal complaints about JUDITH LEVY OWCZARCZAK and OLIVIER JORNOT.
3.???? That, in the absence of an investigation by the Swiss Prosecutor’s Office, I can finally escalate this case to the European Court of Human Rights.
4.???? That is within my legal right to send this letter and the supporting evidence to the press, since at least the Geneva, and Swiss Prosecutor’s Offices have repeatedly failed to react to serious criminal allegations relating to at least Geneva and Vaud, including relating to child protection failures, financial and medical abuses, Swiss public officials (for example, Pascal Emery) and UN officials (for example, David Ogden) and to allegations of systemic corruption, ongoing criminal retribution (including in four Geneva Private Schools) and lack of victims’, professional, judicial, legal and human rights afforded to my British/Irish family for a decade.
