- Introduction: The following couple of verses of Surah An-Nisa are vital to understand that how a perfect balance can be established in societies to ensure that socioeconomic justice prevails at all times.
- Vital Tools: A society is governed by legislature, judiciary & executive and it can only effectively function, if appointments are made purely on merit.
- Three Pillars of a Society: Legislature means; law-making, while judiciary is responsible for justice and executives’ manage the day to day affairs to efficiently run systems in a society.
- Right Person for the Right Job: It is of foremost importance that whosoever has got authority, he / they must make appointment of those persons with whom life, property & wealth can be trusted with.
- Surah An-Nisa, verse no. 58: “Undoubtedly, Allah commends you to pay back the trusts to their owners, and that when you judge amongst people, judge with justice. Undoubtedly how well Allah admonishes you, verily Allah Hears Sees” (04/58).
- Competency and Justice: The above verse clearly tells us that power & authority must be given to the competent and judiciary must ensure justice in this regard. Or that, the laws made by the legislature must be formulated by keeping general public in its prime focus. A strict compliance of the above command will automatically remove following social ills like; nepotism, favoritism, duress, corruption etc from the equation and if anyone doesn’t fulfill his / their duty, as per the above, then they will fall under the category of ‘distrusted’ (or ‘Khaeen / Khayanat’).
- Legislature: With regards to law-making; it is duty & responsibility of government / parliament to formulate laws strictly in accordance to command of Quran & Sunnah to provide justice to the masses.
- Quran & Sunnah: These two are basic tools guidance, as well as an immaculate source of law-making, which can neither be twisted or bend to justify worldly gains.
- We Must Obey Allah SWT & Prophet SAW: The following verse makes it clear that command of Allah SWT and that of Prophet Muhammad SAW will have to be followed unconditionally, because the word ‘obey’ has been used with Allah SWT & Prophet SAW. But unconditional compliance (or word ‘obey’) has not been made available for ‘people in power’, because Allah SWT knew that how people will bend rules to exploit worldly gains.
- Guidance & Justice: It is in view of the above that we have been told that if there is a disagreement, then we must take guidance from Quran & Sunnah and people with authority (i.e. judiciary / judges) must give their honest verdict. Therefore, an opinion, or a Fatwa, or an interpretation, or worldly laws etc can go redundant with trial & error over time. Or we will compromise for worldly gains to deviate from the source. Indeed, we must remember that tomorrow, we all have to return to our Creator.
- Surah An-Nisa, verse no. 59: “'O believers! Obey Allah and Obey the messenger, and those who have power of command amongst you, then again if there may arise any difference amongst you, refers it to Allah and His messenger, if you have faith in Allah and the Last Day. This is better, and its end is best” (04/59).
May Allah SWT help us to fulfill our responsibilities as per guidance of Quran & Sunnah (Aameen).
