Legal Framework for Land Development in Zimbabwe

Zimbabwe, as with any country, has laws that regulate land sales and land development to protect both the buyer and seller. These laws ensure that land sales and development adhere to legal guidelines and procedures that guarantee fairness and transparency.

A thorough understanding of the various Acts is highly recommended if you are involved in the development of estates or investing in large-scale developments. We have listed a number of Acts that govern land sales and land development in Zimbabwe, including the Land Acquisition Act and The Mines Act, both of which have an impact on land development:

Land Acquisition Act (Chapter 20:10) – 1992

The Land Acquisition Act provides for the compulsory acquisition of land for public purposes or in the public interest. This Act defines “public purposes” to include the provision of land for residential, industrial, commercial, or recreational purposes. It also outlines the procedures for the acquisition of land, compensation, and appeals.

It provides for the establishment of the Land Acquisition Board, which is responsible for hearing appeals from persons aggrieved by a compulsory acquisition order. The Act also establishes the Land Compensation Fund, which is responsible for compensating persons whose land has been compulsorily acquired.

Regional Town and Country Planning Act (Chapter 29:12) – 1996

The Regional Town and Country Planning Act provides for the establishment of regional, town, and country planning committees. These committees are responsible for preparing and implementing regional, town, and country plans.

It outlines the procedures for the preparation, amendment, and review of regional, town, and country plans. It also provides for the development control of land, the imposition of development charges, and the preservation of historical and natural features.

Rural Land Act (Chapter 20:18) – 1985

The Rural Land Act provides for the administration and management of rural land in Zimbabwe. This Act defines “rural land” to include communal, resettlement, and any other land outside urban areas.

It outlines the procedures for the acquisition, allocation, and disposal of rural land. It also provides for the development, conservation, and utilization of rural land.

Urban Councils Act (Chapter 29:15) – 1996

The Urban Councils Act provides for the establishment, composition, and functions of urban councils. These councils are responsible for the administration and management of urban areas in Zimbabwe.

The Act outlines the procedures for the establishment, composition, and functions of urban councils. It also provides for the imposition of rates, the regulation of buildings, and the provision of public amenities.

Mines and Minerals Act (Chapter 21:05) – 1961

Mines and Minerals Act (Chapter 21:05) – 1961: This Act governs the exploration, mining, and disposal of minerals in Zimbabwe. It establishes the Mining Affairs Board, which is responsible for administering and regulating the mining industry, including the acquisition and use of land for mining purposes.
