A Legal Encounter!

The lifeblood of any organization is its people. Every organization strive to make connections with their employees as smooth as possible. Also, to empower both the ways, there are certain legal compliance backed by employment contracts, NDAs, certain laws and procedures which is for the betterment of employee and employers both. Here comes the HR Managers of the company who plays a core role when it comes to the legal or lawful matters. This is just because they are likely the first one to know about any work place harassment or any breach of rules by employees.?

This is something our HR community is well versed and have also been part of it enormous time in the span of our career. I am also one of them, have made 100s of people sign their employment contracts, made them understand policies NDA and what not. But in all these hassle there is something which happened only once with me(and i think it was enough).

During the COVID era, when we were working from home, one fine evening when I was about to wind up my office work I got a call from an unknown number on my mobile phone. I thought it might be an important call as during COVID, ringing of phone was full of suspense and thrill as mostly those were for some or the other bad news of someone being infected or have lost the battle. So out of anxiety I picked up the phone and there was an unknown voice came from the opposite side asking me if I am an owner of Emipro! After I informed him that I handle HR over there, further in his conversation he told me his purpose of call which made my head blown.?

He informed me that he is calling from department of grievance handling working under Prime Minister Grievances portal. He said one of an ex employee from Emipro has filed a complaint against us about not clearing his last payable amount. Though I was shocked and frustrated, I was knowing that the complaint has no bases and we have strong reasons for not clearing the amount. But at that point, I felt a need to discuss this matter with management and our legal advisor so I asked the person on phone to share everything on email. Meanwhile I could carry forward my discussion with team.?

This incident became one of its kind wherein we were encountering a legal matters for the first time. In fact it had a strong impact on my mind for a longer period as I still remember how anxiously I used to call my senior and our legal advisor to know if we have any updates in the matter. I almost have rehearsed 5-6 times, how I would face the court room and the judge if asked anything about that employee and the matter. I know its an act called over thinking but you know I am a Bollywood freak and love overacting !?

Later on, when we submitted the details of the employee and the reasons why he got terminated immediately from his services backed by proper proofs and data, complaint against us were removed and things were back on its place. Nevertheless, our ex employee came to meet us after lockdown and also felt sorry for his childish move. Well, whatever the end is, but the time was full of anxiety and stress but had an amazing lesson hidden within!?
