LEGAL CHANGES IN THE IMMIGRATION SYSTEM

United Kingdom’s immigration system is ever-evolving and has gone through various amendments. Recent changes have been made to the immigration laws on the 18th of October 2022. The new amendments are primarily with respect to seasonal worker visas, stay permission for victims of slavery or human trafficking, Ukraine scheme extension and police registration scheme.

The aim of introducing these changes in the immigration system is to simplify the rules and procedures related to immigration to the United Kingdom. One of the changes introduced is with respect to the seasonal worker visa route. Applications to work under this route are now allowed for the poultry sector as well. However, these applications can be made only till 15th November 2022 and all those who are granted this visa will be given permission to stay and work in the United Kingdom till 31st December 2022. After which they are required to leave the country and return home.

This will be followed every year from 18th October to 31st December of that year only for the workers working in the poultry sector. The aim of this change is to balance out the seasonal demand during this time of the year. There will be certain conditions that will have to be followed by the applicants as well as employers hiring overseas workers under this route.

Legal changes in the immigration system have also been introduced with respect to travel bans. With this applications from applicants who have been subject to a travel ban will be refused under the Immigration Act. With respect to cancellation of entry clearance of applicants that will take place on the basis of a person’s presence in the United Kingdom on the ground that it is not conducive to the public good.

With the new changes the citizens of Peru, Columbia and Guyana have now become non-visa nationals. This means that citizens belonging to these nations will no longer require visit visas prior to coming to the United Kingdom. They will be examined and granted entry on arrival. Changes have also been made to the Hong Kong British National Overseas provisions. Children 18 years of age and above can now make their applications under this route independently.

New provisions have also been added to the Youth Mobility visa scheme to bring clarity to the rules and process of this route. Clarifications have been made to the quota setting and ballot processes of the scheme. Amendments have also been made to the skilled worker visa route. These changes are with respect to the ongoing rate, additional pay and maximum permission length of the visa.

A few amendments have also been made to the student visa route. Changes have been made to the sponsorship guidance relating to the remote delivery of course material by sponsors. Besides, academic progression requirements have been corrected. Changes have also been made to the financial requirements to be met by the dependents under this route.
