In Law.com’s “Skilled in the Art” published on Oct. 25, Ropes & Gray IP litigation partner Scott McKeown discussed constitutional concerns regarding Patent Trial and Appeal Board administrative patent judge appointments. The article highlights that Scott, appellate & Supreme Court partner and chair Doug Hallward-Driemeier and IP litigation Matt Rizzolo (all of Washington, D.C) will be conducting a webinar on the topic Nov. 4.

As Mr. McKeown explains in his Patents Post-Grant blog, a three-judge panel recently signaled strongly during arguments that it may have to remove PTAB judges’ civil service protections in order to keep the board viable under the U.S. Supreme Court’s Lucia v. SEC administrative law judge status decision.
