Court’s Ruling

Justice AmitBansal, in delivering the judgment, ruled in favor of Louis Vuitton, granting a permanent injunction against the defendants. The court found that the defendants had violated Louis Vuitton’s intellectual property rights by selling counterfeit products bearing the famous ‘LV’ logo. The judge emphasized that the defendants had taken unfair advantage of the brand’s goodwill, resulting in confusion among consumers.

The court further ordered that all infringing products seized during the investigation be handed over to Louis Vuitton. Additionally, Defendant No. 3, Selloship Services LLP, was directed to block all sub-domains used by the defendants to sell counterfeit Louis Vuitton items.

Key Takeaways

  • Trademark Infringement & Passing Off: The defendants' actions were deemed to constitute both trademark infringement and passing off, undermining Louis Vuitton’s intellectual property rights.
  • Court’s Intervention: With no formal defense from the defendants, the court proceeded with an uncontested ruling, emphasizing the severity of intellectual property violations.
  • Protecting Consumer Trust: This decision highlights the crucial role of safeguarding well-known trademarks to protect consumers from being misled by counterfeit goods.
  • Litigation Costs: The court also directed Louis Vuitton to appear before the Joint Registrar for the determination of litigation costs, ensuring that the brand is adequately compensated for the violation of its rights.

This ruling serves as a significant win for Louis Vuitton and reinforces the importance of legal action in protecting luxury brands against counterfeiting, especially in the digital age.
