Landmark Contempt Verdict Sends A Tough Reminder to Lawyers: An Unprecedented Step in the Right Direction

On 13th October 2023, the Court of Appeal found lawyers Mark Robin Tallala, Mahadeva Gnaneswaran (from the firm previously known as Messrs Richard Talalla & Harun) and the Plaintiff, Jagmohan Singh Sandhu, guilty for contempt of court for filing a witness statement without ever meeting the witness. The examination-in-chief was filed in the Kuala Lumpur Sessions Court on 28th February 2020.
The contempt proceedings was pursued by Bhavanash Sharma , an Advocate and Solicitor himself and the Defendant in the suit at the Sessions Court.
After the Court of Appeal's stern decision was pronounced, the matter was sent back to the Sessions Court for sentencing. The Contemnors could possibly be facing custodial sentences.
