Land and Environment Court decision: The Apartment Design Guide is focused on qualitative objectives, not rigid numeric compliance
The Land and Environment Court has approved an apartment development which (according to the local council) had no apartments that met the solar access design criteria in the Apartment Design Guide.
The decision is significant. It affirms the Apartment Design Guide is a performance-based document where the focus is on the achievement of qualitative objectives, rather than slavish compliance with numerical design criteria.

3 个月It is nice to see that at a time when we have a shortage of dwellings that the ADG is not being treated as a mandated set of design criteria and good design should be approved.

1 年Great outcome for the project Developer, Architect and the City of Sydney Planning & Development CoSPD team. Once the community becomes aware of this decision and its implications, they will be giving their CoSPD team a huge pat on the back for enhancing the design reputation of the Architect and Developer beyond question. Knowing that the CoSPD used community resources to have the design skills of the Architect recognised in such glowing terms by the highest court of appeal will be a great source of pride to the wider community, because just like the CoSPD they are great supporters of design excellence! In turn, the City of Sydney Administration must be overjoyed that their CoSPD team are focusing the communities resources in defending compliance with the SEPP65 Apartment Design “Guide”. A document that gives away the intent of its objectives in its title! Another benefit of this decision will be the pride the State Government can now share with us, knowing that after sounding alarms bells about the alarming inequality in housing affordability, the CoSPD team chose to use the “Guide” to increase the cost of developing this CBD based housing. Bravo to all involved at the CoSPD, a very proud moment for you all.
