LA Law: A Very Common Question We Get Is: If someone co-signs on a loan for us can we have him/her waive interest in the title?

The definitive answer in California is: "Property Ownership

  1. An individual can co-sign a mortgage loan without enjoying any of the perks of owning the home. Accepting responsibility for repaying the loan in the event that the borrower defaults does not grant the co-signer the legal right to seize the property from the borrower should he find himself paying the mortgage each month. The mortgage loan and the actual title to the property are two separate documents and do not have to reflect the same names. If the co-signer’s name does not appear on the property title, he has no legal claim to the home.
