La facilitación del comercio en la forma de pagos en aduanas.

El Artículo 7 del Acuerdo de Facilitación del Comercio de la OMC, referente al "Levante y Despacho de las Mercancías", establece en su segundo numeral lo siguiente:

"2. Pago electrónico: Cada Miembro adoptará o mantendrá, en la medida en que sea factible, procedimientos que permitan la opción de pago electrónico de los derechos, impuestos, tasas y cargas recaudados por las aduanas que se devenguen en el momento de la importación y la exportación”

Esta obligación aduanera no limita la forma en que una administración de aduanas ha de aceptar esos pagos, pudiendo ser en efectivo, tarjeta de crédito, nota de crédito, entre otros. Sin embargo, en el caso del sistema aduanero ecuatoriano, aunque permite el uso de estas formas de pago e incluso su combinación, no es posible que la nota de crédito emitida por el SRI se pueda combinar con otra forma de pago, incluso no es posible combinar efectivo con tarjeta de crédito.

?No resulta extra?o que la nota de crédito emitida por el SRI, una forma de pago, no pueda ser utilizada al querer abonar los tributos del comercio exterior en el sistema financiero de la Aduana cuando se quiere combinar con otras formas de pago?, o ?Por qué no se puede hace un pago con tarjeta de crédito y otra parte con efectivo?

Resulta algo incómodo evidenciar esto, pues uno creería que el sistema aduanero no impondría tales límites. Sin embargo, la realidad es distinta. O bien se abona todo en alguna de las formas de pago disponibles, como efectivo, tarjeta de crédito, con notas de crédito, etc., o bien se combina entre sí, pero solo si la nota de crédito es emitida por el SENAE. No obstante, no se pueden utilizar las notas de crédito del SRI combinadas con otro método de pago ni pagos combinados con tarjeta de crédito.

Por tanto, ?No creen que sería ideal que el Sistema Aduanero pudiera permitir abonos combinando diferentes métodos, incluyendo la nota de crédito emitida por el SRI y el uso de tarjetas de crédito?, esto no afectaría al heraldo tributario y, de hecho, contribuiría a la facilitación del comercio.

Facilitation of Trade in the Form of Payments

Article 7 of the WTO Trade Facilitation Agreement, regarding "Release and Clearance of Goods," states the following in its second paragraph:

"2. Electronic Payment: Each Member shall adopt or maintain, to the extent practicable, procedures allowing the option of electronic payment for duties, taxes, fees, and charges collected by customs incurred upon importation and exportation.”

This customs obligation does not limit the way a customs administration should accept these payments, which can be made in cash, by credit card, credit note, among others. However, in the case of the Ecuadorian customs system, although it allows the use of these payment methods and even their combination, it is not possible for a credit note issued by the SRI to be combined with another payment method, nor is it possible to combine cash with a credit card.

Isn't it strange that a credit note issued by the SRI, a form of payment, cannot be used to pay foreign trade taxes in the customs financial system when combined with other forms of payment? Or why can't a payment be made partly with a credit card and partly in cash?

It is somewhat uncomfortable to notice this, as one would think that the customs system would not impose such limits. However, the reality is different. Either all is paid using one of the available payment methods, such as cash, credit card, credit notes, etc., or it can be combined among themselves, but only if the credit note is issued by SENAE. Nevertheless, SRI credit notes cannot be combined with another payment method, nor can payments be combined with a credit card.

Therefore, don't you think it would be ideal for the Customs System to allow payments combining different methods, including the credit note issued by the SRI and the use of credit cards? This would not affect the tax revenue and, in fact, would contribute to the facilitation of trade.
