Kraj?i delovni ?as zaradi star?evstva
?eprav je to pravica zaposlenega in hkrati obveznost delodajalca, da zaposlenemu omogo?i kraj?i delovni ?as zaradi star?evstva, je potrebno delodajalca o tem obvestiti 30 dni pred nastopom. Zaposleni odda pisno vlogo, na podlagi katere z delodajalcem skleneta aneks k pogodbi. V aneksu je potrebno opredeliti obdobje dela s skraj?anim delavnikom ter ?tevilo ur na teden. Kraj?i delovni ?as mora obsegati najmanj polovi?no tedensko delovno obveznost (20 ur na teden).?
Zakon o star?evskem varstvu in dru?inskih prejemkih (ZSDP-1) v 50. ?lenu podrobno opredeljuje pravice star?ev do kraj?ega delovnega ?asa.
Po sklenjenem aneksu, delodajalec v osmih dneh po nastanku spremembe na portalu eVem zaposlenega odjavi iz obveznega zavarovanja z obrazcem M-2 iz 40 urnega delovnika in ga prijavi z obrazcem M-1 v obvezno zavarovanje za 20 urni delavnik – a pozor, zavarovalni ?as delavca je ?e vedno 40 ur na teden. Kot prilogo k obema obrazcema dodate aneks k pogodbi.
Zaposleni vlo?i obrazec S-3/1?in poleg prilo?i kopijo aneksa k pogodbi na pristojni Center za socialno delo, ki nato delavcu izda odlo?bo. Vse to mora narediti 30 dni od pri?etka dela s kraj?im delovnim ?asom.??
Kdo lahko uveljavlja pravico?
- Eden od star?ev, ki neguje in varuje otroka do tretjega leta starosti,
- eden od star?ev, ki neguje in varuje najmanj dva otroka, ima pravico do dela s kraj?im delovnim ?asom od polnega do kon?anega prvega razreda osnovne ?ole najmlaj?ega otroka, pri ?emer je eno leto izrabe pravice do dela s kraj?im delovnim ?asom od polnega neprenosljivo za vsakega od star?ev,
- eden od star?ev, ki neguje in varuje zmerno ali te?je gibalno oviranega otroka ali otroka z zmerno ali te?jo motnjo v du?evnem razvoju, ima pravico do dela s kraj?im delovnim ?asom od polnega vendar ne dlje kot do 18. leta starosti otroka.
Pogosto iz strani zaposlenih prihaja do zmote, da dr?ava povrne tudi polovico njegove pla?e. Republika Slovenija pla?uje prispevke zavarovanca in delodajalca za obvezno pokojninsko in invalidsko zavarovanje, zavarovanje za primer brezposelnosti, za star?evsko varstvo, za zdravstveno zavarovanje pa prispevke za primer bolezni in po?kodbe izven dela.

Part-time work due to parental rights
While it is both the employee's right and the employer's obligation to allow the employee to work part-time on the grounds of parenthood, the employer must be informed 30 days before the start of the use of parental rights. The employee submits a written application, on the basis of which he and the employer conclude an annex to the contract. The annex must specify the period of part-time work and the number of hours per week. The part-time work must be at least half-time (20 hours per week).
Article 50 of the Parental Care and Family Benefits Act (ZSDP-1) details parents' rights to part-time work.
After the annex has been concluded, the employer must, within eight days after the change has taken place, deregister the employee from compulsory insurance on the eVem portal with the M-2 form for the 40-hour working week and register him/her with the M-1 form for compulsory insurance for the 20-hour working week - but beware that the employee's insurance period is still 40 hours per week. You add an annex to the contract as an attachment to both forms.
The employee submits the S-3/1 form and attaches a copy of the annex to the contract to the competent Social Work Centre, which then issues a?notice to the employee. All this must be done within 30 days of the start of the part-time work.?
Who can claim the right?
There is often a misconception on the part of employees that the state will also reimburse half of his/her salary. The Republic of Slovenia pays the contributions of the insured person and the employer for compulsory retirement and invalidity insurance, unemployment insurance, parental care, and health insurance for sickness and injury outside work.
