SO, IT’S BEEN EXTENDED. WHAT NOW?

As we continue to stand together in our fight to flatten the curve and whilst our innovations are developing rapidly into what seems to be an even newer digital world on the horizon, allow your focus to develop with it.

Countless modes of effortless contact, faster methods in the signature of certain legal documentation and the availability of digital boardrooms and group meeting platforms makes keeping in contact easy. So why not just do it?

Make a note to touch base with your Conveyancer and remember the following important dates:

EXISTING SALES HAVE BECOME MOVING TARGETS AND ESPECIALLY NOW, DON’T FORGET ABOUT YOUR DUE DATES!

1)    Mortgage Bonds & Suspensive Conditions:

Suspensive conditions of sale, for example Purchasers’ due dates for finance approval and those dates relating to subject to sales of Purchasers’ properties must be carefully diarized and extended where needed.

2)    Subject to Sale/s of Purchaser’s properties:

Where your sale is subject to the sale of the Purchaser’s property, don’t forget to diarise the appropriate due dates in respect of this linked transaction, which your sale will be in turn subject to. Keep a strong eye on the progress in the fulfilment of suspensive conditions pertaining to your Purchasers transactions in order to avoid the needless lapsing of your primary sale.

3)    Clearance Certificates:

Rates and Levy Clearance Certificates already issued and due to expire during or shortly after the lock down period are required to be extended and will be attended to by your Conveyancing Team. Where further rates figures are payable by Sellers, same will be requested and new clearance certificates will be issued by the Cape Town Municipality once the lock down has been lifted in order to ensure the validity of these certificates upon the reopening of the Deeds Office.

4)    Occupation and Occupational Rental:

Due consideration must be given to circumstances where occupation of properties were intended to be given and taken during the lock down period and the appropriate Addendum/s concluded to extend these dates and/or regulate the agreement between the parties where required.
