ABSTRACT

The Kashmir Issue stands as a territorial conflict primarily between India and Pakistan, also involving China, over the Kashmir region. Since the early 1990s, it has led to a 'proxy war' between India and Pakistan, straining relations and contributing to South Asia's nuclearization. Pakistan's use of terrorism and human rights abuses by terrorists in Kashmir has posed significant security challenges for India, prompting the Indian army to counter these threats. This research aims to explore the Kashmir issue, India's perspectives, and whether it can ever be resolved.

INTRODUCTION:-

The roots of the Kashmir Issue trace back to the pre-Independence era of India, involving 565 princely states, including the State of Jammu and Kashmir. The state, with distinct regions and diverse religious communities, faced a unique conundrum during the transfer of power to India and Pakistan in 1947. Maharaja Hari Singh, the ruler of Kashmir, faced pressure from both countries due to its geostrategic significance, leading to turmoil and subsequent military involvement.

ARTICLE 370 AND LATER DEVELOPMENTS:-

The inclusion of Article 370 in the Indian Constitution provided special provisions to Jammu and Kashmir, creating controversy and political tensions. Over the years, conflicts, wars, and political changes have marked the region's history. Tensions escalated with Indo-Pak wars, nuclear tests, and persistent efforts to internationalize the issue.

AFTERMATH OF ARTICLE 370:-

Following the abrogation of Article 370, Kashmir witnessed a shift in its dynamics, including decreased terrorist activities and increased foreign investments. However, the move stirred global opinions and debates on human rights concerns and geopolitical implications. The region experienced a peaceful phase after decades of unrest, with infrastructure development and increased tourism.

CONCLUSION:-

The Kashmir Issue, albeit complex, has shown signs of improvement post the abrogation of Article 370. India's firm stance against terrorism has faced human rights criticism, yet ensuring national security remains a priority. Resolution demands addressing international involvement and reintegration of Pakistan-occupied Kashmir (POK) for regional stability and a conclusive solution to the Kashmir Issue.
