Justice Delayed or Denied: A Call for Equal Legal Protections for Men in India
The tragic death of Atul Subhash in Bengaluru has reignited the urgent need for gender-neutral laws in India. Atul, a 34-year-old professional, left behind a 24-page suicide note detailing harassment by his wife and her family, bringing to light the systemic bias against men within the legal framework. While his wife and relatives are reportedly in custody, this raises a critical question: Is this justice enough, or do we need comprehensive reforms to prevent such tragedies?
India’s Constitution guarantees equality before the law (Article 14) and the right to life (Article 21), empowering the judiciary to provide complete justice (Article 142). However, the reality for many men presents a grim picture. Laws such as Section 498A IPC and the Domestic Violence Act, designed to protect women, are often misused, leading to wrongful harassment of men and their families. Custody and maintenance battles disproportionately favor mothers, sidelining fathers, while false allegations ruin reputations and cause financial devastation, with no accountability for the accusers.
Cases like Atul’s, where he displayed a placard reading “Justice is due” before taking his life, and Naveen Tiwari (Veena vs Naveen FAO No. 1767-2017), who spent years battling false dowry allegations, illustrate the urgent need for reform.
Gender-neutral laws, penalties for the misuse of legal provisions, institutional support for men, and family law reforms advocating shared parenting and fair financial settlements are essential steps forward. This is not just about isolated cases, but about setting a precedent for future generations.

Justice delayed or denied is justice lost. It is imperative for lawmakers and the Supreme Court to amend existing laws or introduce new ones that reflect societal realities. Justice is not a privilege, but a right. It’s time to ensure equal protection and fairness for men under the law.
