Just Because You Can.....

The concept of "just because you can do something legally doesn't mean it is necessary" is based on the idea that just because an action is legal, it doesn't necessarily mean that it is the right thing to do in a particular situation. In policing, this concept can be applied in several ways:

  1. Use of force: Just because an officer has the legal authority to use force in a particular situation, it doesn't necessarily mean it is necessary or appropriate. In some cases, it may be possible to de-escalate a situation or resolve a conflict without force.
  2. Search and seizure: Just because an officer has the legal authority to search or seize property in a particular situation, it doesn't necessarily mean it is necessary or appropriate. In some cases, seeking the individual's consent or using other means of obtaining the necessary information may be more effective.
  3. Arrest: Just because an officer has the legal authority to make an arrest in a particular situation, it doesn't necessarily mean it is necessary or appropriate. In some cases, it may be more effective to use other means of resolving a conflict or addressing a problem.

Overall, the concept of "just because you can do something legally doesn't mean it is necessary" is based on the idea that police officers should use their discretion and judgment in deciding how to best serve the community's needs and protect public safety.

Andy Harvey C.P.M., wise thoughts. Expecting officers to exercise "good judgment in the community's best interest" requires a sustainable commitment to selection, hiring, training, education, leadership, accountability, operations, and administration. Unfortunately, the widespread vilification of policing is undermining this process by driving away our best and brightest officers and making it harder to attract new officers.
